PUBLIC NOTICE HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988 PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION SCHILLER SITE RICHMOND TOWNSHIP, CRAWFORD COUNTY Pursuant to Section 1113 of the Pennsylvania Hazardous Sites Cleanup Act, Act of October 18, 1988, P.L. 756, No. 108, 35 P.S. §6020.101-6020.1305 (HSCA), notice is hereby provided that the Pennsylvania Department of Environmental Protection (Department) has entered into a Consent Order and Agreement (CO&A) with Crawford Energy Search Co., Inc. (CESC) concerning the CESCs ownership and redevelopment of the Schiller Site (Site). The Site includes two properties, one containing approximately 107 acres and an adjacent property containing approximately 40 acres. Both properties are located along State Route 77, in Richmond Township, Crawford County Pennsylvania. Between 1970 and 1993, Frank Schiller, the owner and/or operator of the Site, disposed and/or allowed the disposal of waste materials there. These waste materials contained hazardous substances that contaminated the surface water, groundwater, soil, sediments at the Site. Between 1993 and 2000, the Department conducted multiple response actions at the Site, including the investigation and cleanup of hazardous substances in drums, vats, soils, and sediments. However, the Departments groundwater monitoring efforts to date indicate that groundwater at the Site was, and continues to be impacted. On November 17, 1997 the Court of Common Pleas of Crawford County issued a final judgment against Frank Schiller for the Departments costs for cleanup of the Site and the associated Presque Isle Chemical Site in the amount of $7,352,663. A judgment of revival was granted to the Department on June 28, 2006. The Department continues to incur costs at the Site associated with maintaining treatment of a home well and groundwater monitoring at the Site. On September 23, 2011, CESC was the successful bidder at a tax sale for the 107 acre parcel. On September 21, 2012, CESC was the successful bidder at a tax sale for the 40 acre parcel. CESC intends to use the Site property for agricultural use. CESC is aware of the hazardous substances which remain in the groundwater at the Site. CESC, while not a responsible party at the Site acknowledges that it will be responsible for maintaining the Departments response actions at the Site. CESC proposes to pay a total of $118,797.05 to the Department for releasing the Site from the Departments lien against Frank Schiller. The balance of the lien against Frank Schiller will remain against his other assets besides the Site property. The Department will receive and consider comments relating to the CO&A for sixty (60) days from the date of this Public Notice. The Department has the right to withdraw its consent to the CO&A if the comments concerning the CO&A disclose facts or considerations which indicate that the CO&A is inappropriate, improper, or not in the public interest. After the public comment period, the Department's settlement with CESC shall be effective upon the date that the Department notifies CESC in writing, that the CO&A is final and effective in its present form, and that the Department has filed a response to significant written comments to the CO&A, or that no such comments were received. The CO&A is available for inspection and copying at the Departments office at 230 Chestnut Street, Meadville, Pennsylvania.
