PUBLIC NOTICE Notice of Intent to Adopt Ordinance on final reading by the City Council of the City of Meadville. Notice is hereby given that on Wednesday, January 15, 2014 at a Regular meeting, a bill proposing the adoption of the following proposed ordinance was introduced to and considered by City Council of the City of Meadville on first and second reading. Notice is further given that the City Council of the City of Meadville intends to consider the said proposed ordinance on third and final reading at its Regular meeting scheduled for Wednesday, February 5, 2014 at 4:15 P.M. in the Council Chambers at the Meadville City Building, 894 Diamond Park, Meadville, Pennsylvania. The proposed ordinance may be finally passed at that time. BILL NO. 1 OF 2014 CITY OF MEADVILLE CRAWFORD COUNTY, PENNSYLVANIA AN ORDINANCE OF THE CITY OF MEADVILLE, CRAWFORD COUNTY, PENNSYLVANIA, PURSUANT TO ACT 106 OF 2010, WHICH ACT AMENDED, MODIFIED AND/OR REPEALED SEVERAL FOOD-RELATED PENNSYLVANIA STATUTES, TO AMEND ARTICLE 1119 OF THE MEADVILLE MUNICIPAL CODE, THE MEADVILLE RETAIL FOOD FACILITY SAFETY CODE, TO SPECIFICALLY TRANSFER LICENSING AND INSPECTION RESPONSIBILITY TO THE COMMONWEALTH OF PENNSYLVANIA, DEPARTMENT OF AGRICULTURE. BE IT ORDAINED AND ENACTED by the City Council of the City of Meadville and it is hereby Ordained and Enacted by and within the Authority thereof as follows: Section 1. 1119.01 General. (A) This code shall be known as and may be referred to as the Meadville Retail Food Facility Safety Code, and shall amend and supersede existing Article 1119 of the Meadville Municipal Code in its entirety. 1119.02 License Required. (A) It shall be unlawful for any proprietor to conduct or operate a retail food facility within the City of Meadville without first obtaining a license for each facility as required by and issued pursuant to the provisions of all applicable Commonwealth of Pennsylvania statutes, including the Retail Food Facility Safety Act of 2010 (codified at Title 3 Pa.C.S.A. § 5701 et. seq.), the Food Safety Act of 2010 (codified at Title 3 Pa.C.S.A. § 5721 et. seq.), and the Food Employee Certification Act of 2010, (codified at Title 3 Pa.C.S.A. § 6501 et. seq.), and the Food Code, Chapter 46, and all related rules and regulations. 1119.03 Compliance. (A) Every person who shall conduct or operate a retail food facility within the City shall comply with the requirements of the Retail Food Facility Safety Act of 2010, the Food Employee Certification Act of 2010; and the Food Safety Act of 2010. (B) The Commonwealth of Pennsylvania, Department of Agriculture, through its health authorities, shall license and inspect all retail food facilities pursuant to the authority granted by the Retail Food Facility Safety Act of 2010, and other applicable Commonwealth statutes. (C) The laws and regulations of the Commonwealth of Pennsylvania, including the Retail Food Facility Safety Act of 201, shall govern applicable licensing and inspection fees, as well as enforcement and penalties for non-compliance. Section 2. Effective Date. The provisions of this Ordinance shall become effective at 12:01 a.m., prevailing time, on the 21st day following the date of passage and enactment. With respect to the transfer of licensing and inspection authority to the Commonwealth of Pennsylvania, this Ordinance shall be retroactively effective as of January 1, 2014. Section 3. Severability. Should any section, part or provision of this Ordinance be declared by appropriate authority to be unlawful or unconstitutional, all other terms, conditions, provisions and parts hereof, and of any Code of which this Ordinance may be or may be considered to be part, shall continue in full force and effect as if the provision declared to be unlawful or unconstitutional had been omitted as of the date of final enactment hereof. Section 4. Repealer. All ordinances and part of ordinances inconsistent herewith are hereby repealed.
