FORECLOSURE SALE Default having been made by failure to comply with the terms and conditions of a certain Deed of Trust dated November 16, 1995, executed by Kevin Price, Keith Price, Shannon Price and Adam Price and Vickie A. Price, recorded in Book M507, Page 769, re-recorded in Book M509, Page 498 and re-recorded in Book M510, Page 318, Register's Office for Cumberland County, Tennessee, and wherein the said Kevin Price, Keith Price, Shannon Price and Adam Price and Vickie A. Price conveyed the property therein described to Joy Buck, Trustee, to secure the indebtedness therein described, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust and note, and payment not having been made as demanded; and the undersigned, Joel E. Jordan, of 3326 Aspen Grove Drive #604, Franklin, Tennessee 37067, having been appointed as Substitute Trustee in the place and stead of Joy Buck, Trustee, said appointment being set forth in the Register's Office for Cumberland County, Tennessee, notice is hereby given that I, Joel E. Jordan, Substitute Trustee, having been requested so to do by the lawful owner of said indebtedness, will on Tuesday, November 25, 2014, at 12:00 Noon at the Front door of the Cumberland County Courthouse, Crossville, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower, and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described real estate in Cumberland County, Tennessee: LYING AND BEING TN THE SIXTH (6TH) CIVIL DISTRICT OF CUMBERLAND COUNTY, TENNESSEE, BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING ON A STONE IN GOLLIHER LINE 8 FEET WEST OF HULIN HENERYS NORTHWEST CORNER; THENCE SOUTH 10 EAST IS POLES TO A STONE 8 FEET WEST OF SAID HENRYS LINE; THENCE WEST 18 POLES TO STONE; THENCE S 12 DEG WEST 17 POLES TO STONE IN SAM PRICES 13 ACRE TRACT; THENCE NORTH 70 DEGREES W 20 POLES WITH SAID PRICE LINE AND NORTHWEST CORNER OF SAID 13 ACRE TRACT; THENCE NORTH 5 DEGREES EAST 23 POLES TO LARGE MAPLE IN HOLLOW; THENCE NORTH 87 DEGREES EAST 40 POLES TO THE BEGINNING, CONTAINING 5-7/8 ACRE, MORE OR LESS, AS SURVEYED BY C.B. MCLEAN, FEBRUARY 8, 1941. THERE IS EXCLUDED FROM THIS CONVEYANCE AN 1-1/2 ACRE TRACT OF LAND WHICH HAS HERETOFORE BEEN CONVEYED TO OVAL LOU EDDINGTON. BEING A PART OF THE SAME PROPERTY CONVEYED TO H.L. PRICE ET UX, ALLIE PRICE, FROM SAM L PRICE ET UX, ELLA PRICE, BY DEED DATED FEBRUARY 8, 1941 OF RECORD IN THE REGISTER'S OFFICE FOR CUMBERLAND COUNTY, TENNESSEE, TN DEED BOOK 27, PAGE 139. ALLIE PRICE DIED AUGUST 5, 1986, AND LEFT SURVIVING HER HESTEL L PRICE, WHO RECEIVED THE FEE SIMPLE TITLE TO THE ABOVE DESCRIBED REAL ESTATE AS THE SURVIVING TENANT BY THE ENTIRETY. Being the same property conveyed to Kevin Price, Keith Price, Shannon Price and Adam Price, by Warranty Deed from Hestel L. Price dated January 28, 1993 and recorded in Book D444, Page 337, Register's Office of Cumberland County, Tennessee and Affidavit of Heirship of Samuel Adam Price, dated June 17, 1995 and recorded in Book D1201, Page 2103. The Life Estate retained in Book D444, Page 337 was extinguished upon the death of Hester L. Price (a/k/a H.L. Price). Included in this conveyance is a 1996 Homes of Legend mobile home, Serial #HL5169AL. This is improved property known as 113 Kindred Road, Rockwood, Tennessee 37854. The 2014 taxes are currently due and payable. The following person(s) or entity(ies) hold a Deed of Trust, lien or other encumbrance on the above described property: Citifinancial Judgment Lien Book 1246, Page 826 Thomas E. Price Judgment Lien Book 1280, Page 2497 Ford Motor Credit Judgment Lien Book 1401, Page 1454 The said property is subject to a notice of State Tax Lien in favor of the State of Tennessee of record in Book 1157, Page 1243, Register's Office for said County. Notice as required by T.C.A. 67-1-1433(b)(1) has been timely given to the State of Tennessee and said sale will be subject to the right of the Internal Revenue Service to redeem the land as provided for in T.C.A. 67-1-1433(c)(1). Said sale is subject to any and all unpaid taxes and any other prior claims, liens, easements, set back lines and restrictions. THE RIGHT IS RESERVED TO ADJOURN THE DAY OF THE SALE TO ANOTHER DAY, TIME AND PLACE CERTAIN WITHOUT FURTHER PUBLICATION, UPON ANNOUNCEMENT AT THE TIME AND PLACE FOR THE SALE SET FORTH ABOVE. THE TRUSTEE/SUBSTITUTE TRUSTEE RESERVES THE RIGHT TO RESCIND THE SALE.
