NOTICE OF SUBSTITUTE TRUSTEE'S LAND SALE WHEREAS, CATHY KNIGHT executed a certain Deed of Trust to PHILLIP L. CRAWFORD, Trustee, on the 14th day of September 2012, to secure payment of a certain note to the FIRST NATIONAL BANK OF PIKEVILLE, Pikeville, Tennessee, converted to FIRST FARMERS AND COMMERCIAL BANK, a continuation of First National Bank of Pikeville, Pikeville, Tennessee, a state-chartered commercial bank, said trust conveyance being of record in Trust Deed Book 1393, Page 287, Register's Office, Cumberland County, Tennessee, to which reference is hereby made for full contents thereof; AND WHEREAS, due to the inability of PHILLIP L. CRAWFORD to act as Trustee, HOWARD L. UPCHURCH was appointed Substitute Trustee by the holder of said note, which appointment is of record in Book 1438, Page 615, Register's Office, Cumberland County, Tennessee; AND WHEREAS, said trust conveyance provides for the sale of the property hereinafter described in the event of default of the payment of the indebtedness and additional loans or future advances secured thereby; AND WHEREAS, default has been made in the payment of the indebtedness or the conveyance securing said indebtedness. NOW THEREFORE, by virtue of the authority in me vested as Substitute Trustee under the aforesaid trust conveyance, I will, on Wednesday, December 3, 2014, at the Cumberland County Courthouse in Crossville, Tennessee, at the front and Main Street entrance of the courthouse, at the hour of 11:30 o'clock a.m. CST, offer for sale, and sell to the highest and best bidder, for cash in hand, and free from the equity of redemption, homestead and dower, and all other exemptions and rights of every kind, all of which are expressly waived in said Deed of Trust, the following described tracts or parcels of land lying in the First Civil District of Cumberland County, Tennessee: Beginning on a 1/2 inch pipe (set) in a fence marking the southern boundary of John Crowder said pipe is the northeast corner of this described parcel and also a corner of Agnes Lewis (Deed Book 1137, Page 461) and is farther located N56-59-29W 27.8 feet from a utility pole approximately 425 feet North of the center of Pomona Road, thence leaving Crowder and going with the remainder of the Agnes Lewis property S17-35-49E 104.83 feet to a 1/2 inch pipe (set), S70-36-47W crossing 15 foot easement 82.75 feet to a inch pipe (set), thence N26-49-08W 25.60 feet to a 1/2 inch pipe (set), S71-30-30W 20.62 feet to a 1/2 inch pipe (set) and N20-25-01W 135.47 feet to a steel fence post (found) in the aforementioned fence that marks the southern boundary of Crowder thence leaving Agnes Lewis and going with Crowder S82-44-45E 125.74 feet to the beginning containing 0.32 acres as surveyed by the David H. Bradley-Land Surveying Company R.L.S. No. 1137 on 16th of January 2006. The following is a description of a portion of the Agnes L. Lewis property located on Pomona Road in the First (1st) Civil District of Cumberland County, Tennessee (referenced Deed Book 1137, Page 461, Tax Map 72, Parcel 73.00) and is more particularly described as follows: Beginning on a stake located in the Southern boundary of John Crowder, said stake is the Northwest corner of this described parcel and Northeast corner of the Fred Yoakam property thence leaving Yoakam and going with Crowder S 82 deg 44 min 45 sec E, 20.74 feet from a utility pole, thence leaving Crowder and going with the remainder of the Agnes Lewis property S 17 Deg 35 Min Sec E. 104.83 feet to a 1/2 inch pipe (set) 70 Deg 36 Min 47 Sec W, crossing a 15 foot easement 82.75 feet to a 1/2 inch pipe (set), N26 Deg 49 Min 08 Sec W, 25.60 feet to a 1/2 inch pipe (set) S71 Deg 30 Min 30 Sec W. 20.62 feet to a 1/2 inch pipe (set) and N 20 Deg 25 Min 01 Sec W. 30.47 feet to a stake marking the original southwest corner of Fred Yoakam, thence leaving the remainder of the Agnes Lewis property and going with Yoakam S 82 Deg 44 Min 45 Sec E 105.00 feet and N 20 Deg 25 Min 01 Sec W, 105.00 feet to the beginning containing 0.0967 acres as surveyed by the David Bradley-Land Surveying Company R.L.S. No. 1137 on 16th of January 2006. Being the same property conveyed to Cathy Knight by Quitclaim Deed from the United State of America, of record in Book 1393, Page 275, Register's Office, Cumberland County, Tennessee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place set forth above. The sale held pursuant to this Notice may be cancelled at the Substitute Trustee's option at any time. If the highest bidder cannot pay the bid within the time period established by the FIRST FARMERS AND COMMERCIAL BANK, a state-chartered commercial bank, following the sale, then the Substitute Trustee will accept the next highest bidder, at his or her highest bid, which will then be deemed the successful bidder. This sale is an attempt to collect a debt and any information obtained will be used for that purpose. The following parties may claim an interest in the above described property: CATHY KNIGHT, FIRST FARMERS AND COMMERCIAL BANK, a state-chartered commercial bank, and the UNITED STATES OF AMERICA.
