Savage Road, LaVale, Maryland improved by a car wash together with all fixtures and equipment (29-044007); 3) Diamond Shine Car Wash lease hold interest West Industrial Boulevard and White Oak Avenue improved by a car wash together with all fixtures and equipment subject to terms of a lease dated August 8, 1998 and recorded in Book 734, page 15 (04-050967); 4) Two story office building with onsite parking Queen City Triangle, Queen City Drive at Harrison and George Streets (22-015761). Under and by virtue of a deed of trust and leasehold dated August 9, 2004 and recorded in Book 1079, page 01 and modified by an addendum dated August 31, 2004 and recorded in Book 1082, page 494 and modification of deed of trust dated August 6, 2007 and recorded in Book 1425, page 233 and under and by virtue of a deed of trust and leasehold dated August 9, 2004 and recorded in Book 1079, page 28 and modified by an addendum dated August 31, 2004 and recorded in Book 1082, page 494, and having been duly appointed Substitute Trustee, default having been made under the agreements, covenants and conditions of said deed of trust, the undersigned will offer for sale at public auction at the front doors of the Circuit Court for Allegany County, on Tuesday, November 25, 2014 at 11:00 a.m. 1) All that lot, piece or parcel of ground described in a deed dated June 7, 1995 and recorded in Book 627, page 198 and in the deeds of trust recorded in Book 1079, page 01 and Book 1079, page 28, among the Land Records for Allegany County, Maryland. 2) All that lot, piece or parcel of ground described in a deed dated September 29, 1992 and recorded in Book 605 page 78 and in the deeds of trust recorded in Book 1079, page 01 and Book 1079, page 28 among the Land Records for Allegany County, Maryland. 3) All that leasehold interest, piece or parcel of ground described in a lease dated August 7, 1998 and recorded in Book 734, page 15 and in the deeds of trust recorded in Book 1079, page 01 and Book 1079, page 28 among the Land Records for Allegany County, Maryland. 4) All that lot, piece or parcel of ground described in a deed dated November 3, 1999 and recorded in Book 676, page 658 and in the deeds of trust recorded in Book 1079, page 01 and Book 1079, page 28 among the Land Records for Allegany County, Maryland. 5) Also pursuant to two security agreements dated August 9, 2004 granting a security interest on all inventory, equipment, fixtures, etc., the car wash equipment will be offered for sale together with and separate from the real estate. TERMS OF SALE: Properties will be offered individually and as a package of three car washes with the office building. Properties will be offered for sale both together with and separate from the fixtures, equipment and inventory subject to the security agreement. Substitute Trustee reserves the right to reject any and all bids. Twenty Thousand Dollars ($20,000.00) cashier’s or certified check per parcel on day of sale and balance within fifteen (15) days after the ratification of sale by the court unless otherwise arranged with the Substitute Trustee. A deposit for the purchase of the fixtures, equipment and inventory alone of Seven Thousand Five Hundred Dollars ($7,500.00) per location will be required. Bidders must prequalify. Any buyer other than the note holder is required to pay interest on the unpaid purchase price from the date of sale to closing at the rate of 5% per annum. Time is of the essence. Costs of recordation stamps and transfer taxes will be paid by the Buyer. All state, county and city real estate taxes, and water and sewer charges will be adjusted as of the date of sale. Rent on the ground lease shall also be adjusted as of the date of the public sale. The property is sold in “as is” condition with no representation as to structural integrity, state of repair or the absence of any hazardous material. All fixtures, equipment and inventory are “as is” “where is”. Cost of removal and necessary repair of the structure caused by removal shall be paid by Buyer. Description of the improvements was accurate at the time received by the lender; no assurances are intended as to the current condition. Purchaser shall be responsible for removing anyone in possession of the premises. If Substitute Trustee is unable to convey good and marketable title, the purchaser’s sole remedy in law or in equity shall be limited to a refund of the deposit. Upon refund of the deposit, the sale shall be void and of no effect, and the purchaser shall have no further claim against the Substitute Trustee.
