NOTICE OF FORECLOSURE SALE STATE OF TENNESSEE, CUMBERLAND COUNTY WHEREAS, Willie Mae Davis executed a Deed of Trust to Citifinancial Services, Inc., Lender and Freida Lowery, Trustee(s), which was dated October 9, 2007 and recorded on October 9, 2007 in Book 1277, Page 221, Cumberland County, Tennessee Register of Deeds. WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, CitiFinancial Servicing LLC, ("the Holder"), appointed the undersigned, Brock&Scott, PLLC, as Substitute Trustee, by an instrument duly recorded in the Office of the Register of Deeds of Cumberland County, Tennessee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock&Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on December 9, 2014, at 1:30PM at the usual and customary location at the Cumberland County Courthouse, Crossville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Cumberland County, Tennessee, to wit: The following described premises, being in the Fourth Civil District of Cumberland County, State of Tennessee, known and described as follows, to-Wit: Map 129L, Group B, Parcel 5.00 beginning at a cedar tree which lies 200 feet South 26 West from the North West corner of the John H. Reed tract ; thence North 26 East 200 feet to the North West Corner of the John H. Reed tract; Thence S. 64 East 274 feet to the North East corner of the John H. Reed tract; thence South 26 West 146 feet to a rock ledge in the line of John H. Reed; thence a straight line to the beginning, being 1 acre more or less. However there is hereby excluded from the above described tract and not meant to be herein conveyed the following tracts of land: exclusion No. 1: being the same property conveyed to Clarence W. Haney and wife, Joyce Ann Haney, by virtue of a deed from Ocia Haney, dated August 20, 1981, in Deed Book 241, Page 530, Register's Office, Cumberland County, Tennessee, and described as follows: Beginning at the extreme Northwest corner of the original tract of which this is a part; thence with the original North line South 64 degrees East 50 feet to a stake; thence leaving said North line South 12 degrees 30 minutes West 107 feet to a stake; thence South 83 degrees East 83 feet to a stake in the original West boundary line; thence North 26 degrees East 130.5 feet to the beginning. Containing 0.17 acres, more or less. Exclusion No.2: being the same property conveyed to George W. Haney and wife, Pauline Ann Haney, by virtue of a deed dated August 20, 1981, from Ocia Haney, of record in Deed Book 241, Page 532, Register's Office, Cumberland County, Tennessee, and described as follows: beginning at the extreme Southeast corner of the tract of which this is a part; thence with the original South line North 73 degrees 45 minutes West 100 feet to a stake; thence leaving said South line North 27 degrees East 83 feet to a stake; thence South 66 degrees East 100 feet to the original East line; thence with said East line South 26 degrees West 69 feet to the beginning. Containing 0.18 acres, more or less. Being the same fee simple property conveyed by Quit Claim Deed from Alma Joyce Davis and Irma Faye Elmore and Willie Mae Davis, et al to Willie Mae Davis, dated 09/06/1994 recorded on 11/03/1994 in or Book D 477, Page 551 in Cumberland County Records, State of TN. Parcel ID Number: 129L B 00500 000 Address/Description: 28 Short Street, Crab Orchard, TN 37723. Current Owner(s): Willie Mae Davis. Other Interested Party(ies): .N/A The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
