Kazary, Esquire Attorney at Law 127 Greene Street Cumberland, Maryland 21502-2928 SUBSTITUTE TRUSTEE SALE OF VALUABLE FEE SIMPLE DWELLING 14514 McMullen Highway Cumberland, MD 21502 Under and by virtue of the power of sale contained in a certain Deed of Trust from Jacy Witt and DIRNDL, LLC, unto Karen Robison, dated August 30, 2013, and recorded in Liber 1998, Folio 492 among the Land Records of Allegany County, Maryland; the hold of the indebtedness secured by the Deed of Trust having appointed Robert O. Kazary substitute trustee by instrument duly executed, acknowledged and recorded among the land Records of the County aforesaid, default having occurred under the terms thereof and at the request of the parties secured thereby the undersigned substitute trustee will offer for sale at public auction. AT THE CIRCUIT COURT FOR ALLEGANY COUNTY, MARYLAND AT THE COURT HOUSE DOOR, CUMBERLAND, On Tuesday, December 2, 2014, @ 10:00 AM ALL that lot or ground and the improvements thereon situate in Allegany County, Maryland and more fully described in the aforesaid deed of trust. The property is improved by a dwelling and is in fee simple. The property address is 14514 McMullen Highway, Cumberland, Allegany County, Maryland. The property will be sold in an “as-is” condition and subject to the conditions, restrictions and agreements of record affecting the same, if any, with no warranty as to the description of the improvements. Terms of sale: a deposit of $5,000.00 (Five Thousand Dollars) will be required at the time of sale, such deposit to be in cash, cashier’s check, certified check, or in other form as the substitute trustee may determine acceptable in his sole discretion. Balance of the purchase price to be paid in cash within ten (10) business days of the final ratification of sale by the circuit court for Allegany County, Maryland. If payment of the balance does not take place within ten (10) days of ratification, the deposit will be forfeited and the property resold at the risk and expense of the defaulting purchaser. Interest to be paid on the unpaid purchase money at the rate pursuant to the deed of trust note from the date of sale to the date of settlement in the event that the property is purchased by someone other than the note holder. Taxes and water rent to be adjusted to the date of sale. All other public charges and assessments payable on an annual basis including the city taxes to be adjusted for the current year to the date of sale and assumed thereafter by the purchaser. Cost of all documentary stamps and transfer taxes shall be born by the purchaser. If the substitute trustee is unable to convey good and marketable title, the purchaser’s sold remedy in law or equity shall be limited to the refund of the deposit of the purchaser. Upon refund of the deposit this sale shall be void and of no affect, and the purchaser shall have no further claim against the substitute trustee. The purchaser at the foreclosure sale shall assume the risk of loss for the property immediately after sale. The purchaser shall be responsible for securing possession of the property. Robert O.
