TRUSTEE'S NOTICE OF SALE Default having been made in the payment of the debts and obligations secured to be paid by a certain deed of trust executed by William Ayers and wife, Charlotte Ayers on the 18th day of October, 2006, to Don Calcote, Trustee, as same appears of record in Book 1246, page 1927, which deed of trust was modified on March 15, 2013, by Modification Agreement recorded in Book 1406, page 1432, and including an Affidavit of Affixation for mobile home dated March 15, 2012, and recorded in Book 1417, page 2213, all in the Register's Office of Cumberland County, Tennessee; and Don O. Johnson having been appointed Substitute Trustee per instrument recorded in Book 1435, page 2023; and Community Bank of the Cumberlands, which by reason of merger is now known as SouthEast Bank, being the owner and holder of the debt secured, having requested the undersigned to advertise and sell the property described in and conveyed by the said deed of trust, all of the said indebtedness having matured by default in the payment of a part thereof, this is to give notice that the undersigned will on December 3, 2014, commencing at 3:00 p.m., at the front door of the Cumberland County Courthouse, Crossville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described tract of property, to-wit: Located in the First Civil District of Cumberland County, Tennessee, to-wit: BEGINNING on a point located in the Southern R.O.W. of Fredonia Road; thence with said road R.O.W. for the next three (3) courses and distances; (1) North-81 degrees-58 minutes-17 seconds-East 380.47 feet to a point; (2) South-89 degrees-26 minutes-43 seconds-East 59.00 feet to a point; (3) South-72 degrees-39 minutes-16 seconds-East 61.53 feet to a fence post, said point being the Northeast corner of the original tract of this tract is a part and also being the Northwest corner of a tract of land that is owned by Jimmy Buckner; thence leaving said R.O.W. and with the common line between the original tract and said Jimmy Buckner South-18 degrees-48 minutes-06 seconds-West 487.00 feet to a point; thence leaving said Buckner North-64 degrees-55 minutes-32 seconds-West 459.81 feet to a point; thence North-18 degrees-48 minutes-06 seconds-East 245.00 feet to the point of BEGINNING. Containing 4.00 acres more or less. The preceding described tract of land and acreage calculation were drawn up from data furnished to me by the owner and was not actually surveyed by O.D. Pugh, Jr., R.L.S. #699, located at 107 Livingston Road, Crossville, Tennessee 38555, dated March 23, 2001. Job Number (1062-1). The above-described real property is conveyed together with improvements constructed upon, affixed thereto or located thereon, including without limitation any residential dwelling located thereon, including but not limited to a manufactured home, as herein below described, which manufactured home is permanently affixed to the land and shall be conclusively deemed to be real estate. 2006 Horton/Mirage Mobile Home, Manufacturers Serial No. H-184744GL-R. The previous and last conveyance being a deed from Gertie Marie Shepherd, et al., to Charlotte Ayers, of record in the Register's Office of Cumberland County, Tennessee, in Book 1071, page 1996. The street address of the above-described property is believed to be 1311 Fredonia Road, Crossville, Tennessee (Tax Map0 073, Parcel 24.01, Tax Assessor's Office), but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description referenced herein shall control. Said sale shall be subject to any unpaid property taxes, to any additional prior, liens, leases, encumbrances, to any rights of redemption not heretofore expressly waived, and to all applicable reservation of minerals, easements, rights-of-way, setback lines and restrictions. STATE TAX LIEN: Such property is subject to a Notice of State Tax Lien in favor to the State of Tennessee, of record in Book 1367, page 1651, Register's Office for Cumberland County, Tennessee. Notice of said sale required by T.C.A. Section 67-1-1433(b)(1) to be given to the State of Tennessee has been timely given, and said sale will be subject to the right of the State of Tennessee to redeem such property, as provided in T.C.A. Section 67-1-1433(c)(1). OTHER INTERESTED PARTIES: State of Tennessee, Department of Revenue; Tenant(s) rights in possession, if any. The equity of redemption, homestead, dower, and all other rights and exemptions of every kind are waived in said deed of trust, and the title is believed to be good, but the undersigned will sell and convey only such title as he may convey as Substitute Trustee there being no representations or covenants of warranty of title made hereby. It will be the responsibility of the successful bidder to obtain possession of the property at his expense, and any damage, vandalism, theft, destruction, or other loss or damage to the property occurring subsequent to the date of sale shall be at the risk of the successful bidder. The Substitute Trustee reserves the right to postpone or set over the date of sale in the event the Substitute Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, with such notice of postponement as deemed reasonable by the Substitute Trustee. In the event the highest bidder at such sale fails to complete his purchase of the subject real property within the applicable time allowed, the undersigned Substitute Trustee reserves the right to complete the sale of the subject real property, without further notice or advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Substitute Trustee.
