NOTICE OF SUBSTITUTE TRUSTEE'S SALE WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated May 16, 2011, executed by HAROLD W. WHEELER AND PAMELA R. WHEELER, conveying certain real property therein described to H. WALLACE MORONEY, ESQ., as Trustee, as same appears of record in the Register's Office of Cumberland County, Tennessee recorded May 20, 2011, in Deed Book 1362, Page 445-460; and WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to USAA FEDERAL SAVINGS BANK who is now the owner of said debt; and WHEREAS, the undersigned,Rubin Lublin TN, PLLC, having been appointed as Substitute Trustee by instrument to be filed for record in the Register's Office of Cumberland County, Tennessee. NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that the undersigned, Rubin Lublin TN, PLLC, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee will, on December 18, 2014 at 11:00 AM at the Main Entrance Steps of the Cumberland County Courthouse , located in Crossville, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Cumberland County, Tennessee, to wit: LYING AND BEING IN THE THIRD CIVIL DISTRICT OF CUMBERLAND COUNTY, TENNESSEE, BOUNDED AND DESCRIBED AS FOLLOWS: BEING THE SURFACE ONLY OF LOT NO. 14 OF THE MERIDIAN SUBDIVISION, PHASE IV, PLAT III AS SHOWN BY PLAT OF RECORD IN PLAT BOOK 10, PAGE 72; AND CONTAINING 2.40 ACRES, MORE OR LESS, THIS CONVEYANCE, HOWEVER, BEING BY THE BOUNDARY AND NOT BY THE ACRE. SAID SUBDIVISION BEING A PART OF ITEM C11 IS CONVEYANCE TO PPIT OF RECORD IN DEED BOOK 60, PAGE 67 ET SEQ. AND AS AMENDED BY THIRD CHANGE THERETO OF RECORD IN DEED BOOK 375, PAGE 778, ET SEQ. THIS CONVEYANCE IS MADE SUBJECT TO ANY AND ALL EXISTING EASEMENTS, LAWFUL RIGHTS-OF-WAY, PUBLIC ROADS AND HIGHWAYS WHICH MAY PASS OVER, ACROSS OR THROUGH THE SAID LAND OR ANY PART OF SAME. IT ALSO IS MADE SUBJECT TO THE FOLLOWING RESTRICTIONS. NO MOBILE OR MODULAR HOMES SHALL BE PLACED ON ANY TRACT. ALL DWELLINGS MUST CONTAIN AT LEAST 1200 SQUARE FEET OF HEARD AREA. NO COMMERCIAL ACTIVITY SHALL BE ALLOWED ON PREMISES. NO CLOVEN HOOFED ANIMALS (PIGS, GOATS, COWS, ETC.) SHALL BE ALLOWED. A STATE APPROVED SEWAGE DISPOSAL SYSTEM MUST BE INSTALLED FOR EACH DWELLING. PETS SHALL BE LIMITED TO DOGS, CATS AND HORSES, BUT NOT FOR COMMERCIAL PURPOSES. ALL BUILDINGS SHALL BE SET BACK AT LEAST 35 FEET FROM THE ROAD RIGHT-OF-WAY. A 15 FOOT UTILITY EASEMENT IS RESERVED ON EACH SIDE OF ALL ROAD RIGHTS-OF-WAY. NO TREES SHALL BE CUT WITHING 25 FEET OF EACH SIDE AND REAR LOT LINE EXCEPT IN THE CREEK AND ROADS. THESE RESTRICTIONS SHALL BE ENFORCEABLE FOR A PERIOD OF TWENTY YEARS AND UNLESS 75% OF THE LAND OWNERS IN PHASE IV OBJECT SHALL BE RENEWED FOR AN ADDITIONAL 20 YEARS THEREAFTER,. THIS CONVEYANCE IS MADE FOR THE SURFACE ONLY, ALL OTHER MINERALS HAVING BEEN RETAINED BY A PREVIOUS GRANTOR. WHEELER The sale of the above-described property shall be subject to all matters shown on any recorded plat; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. This property is being sold with the express reservation that it is subject to confirmation by the lender or Substitute Trustee. This sale may be rescinded at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
