SUBSTITUTE TRUSTEE'S SALE Default having been made in the payment of the debts and obligations secured to be paid by a certain Deed of Trust executed June 20, 2008 by Rodney Lindsey, joined by his wife, Twana Lindsey to Stewert Title, as Trustee, as same appears of record in the office of the Register of Cumberland County, Tennessee, in Book 1296, Page 1410 and corrected by Scrivener's Affidavit recorded in Book 1426, Page 2420, and the undersigned having been appointed Substitute Trustee by instrument recorded in Book 1423, Page 1918, in the said Register's Office, and the owner of the debt secured, Bayview Loan Servicing, LLC, a Delaware Limited Liability Company, having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust, all of said indebtedness having matured by default in the payment of a part thereof, at the option of the owner, this is to give notice that the undersigned will, on Wednesday, January 7, 2015 commencing at 03:00 PM, at the Front Door of the Courthouse, Crossville, Cumberland County, Tennessee proceed to sell at public outcry to the highest and best bidder for cash, the following described property, towit: Situated in County of Cumberland, State of Tennessee. Situated, Lying and being in the First (1st) Civil District of Cumberland County, Tennessee, bounded and described as follows: Beginning on a stake in the South right-of-way line of Miller Avenue, same being Mary Katherine Pattons Northwest corner; thence with the South right-of-way line of Miller Avenue North 42 1/2 West 106 feet to a stone at the intersection of same with the East right-of-way line of Godsey Street; thence with the East right-of-way line of Godsey Street South 26 3/4 West 307 feet to a stake; thence South 86 1/2 East 113 feet to a stake, the Southwest corner of Mary Katherine Patton North 20 1/2 East 166 feet, North 41 East 66 feet to the beginning. However, there is excepted from the above described property a tract described as follows: Beginning on a stake in the South right-of-way line of Miller Avenue, same being Mary Katherine Pattons Northwest corner; thence with the South right-of-way line of Miller Avenue North 42 1/2 West 106 feet to a stake at the intersection of same with the East right-of-way line of Godsey Street; thence with the East right-of-way line of Godsey Street about South 26 3/4 West 211 feet; thence about South 86 1/2 East 97 feet; thence Northeastwardly 18 feet to the beginning. Tax Parcel ID: 113B-C-022 Property Address: 35 Godsey Street, Crossville, TN. All right and equity of redemption, homestead and dower waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
