NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS This notice shall satisfy two separate but related procedural requirements for activities to be undertaken by the Union County Commissioners. REQUEST FOR RELEASE OF FUNDS On or about January 16, 2015, the Union County Commissioners, on behalf of Lewisburg Borough, will submit a request to the Department of Community and Economic Development (DCED) for the release of Community Development Block Grant (CDBG) funds, FFY 2012 - C000052848 and FFY 2014, in the approximate aggregate amount of $52,820, under Title I of the Housing and Community Development Act of 1974, Public Law 93-383, as amended, to undertake a project known as Lewisburg Boroughwide Curbcuts. Anticipated activities associated with this project include replacement/upgrade of non-compliant curbs throughout the Borough. Priority curbcut replacements will be located throughout Ward I, which is bounded by Saint Anthony Street and Buffalo Road on the north, North 5th Street on the west, Market Street on the south, and the West Branch Susquehanna River on the east. These non-compliant curbs represent an architectural barrier and are a violation of the Americans with Disabilities Act. Additionally, they are inconsistent with the Borough's Accessibility Plan, and represent risk of vehicular/pedestrian accidents. Concrete will be used for the construction of the curbs and curbcuts; truncated dome surfacing will be used at the juncture with streets to provide both a visible and tactile notification to user. No new earth disturbance is expected to occur as a result of the project. FINDING OF NO SIGNIFICANT IMPACT The Union County Commissioners have determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at SEDA-Council of Governments, 201 Furnace Road, Lewisburg, PA, and may be examined or copied weekdays 8:00 A.M. to 4:00 P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Teri Provost, SEDA-Council of Governments, 201 Furnace Road, Lewisburg, PA 17837. All comments received by January 15, 2015, will be considered by the Union County Commissioners prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The Union County Commissioners certify to DCED that Diana Robinson, in her capacity as Chief Clerk, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DCED's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Union County to use Program funds. OBJECTIONS TO RELEASE OF FUNDS DCED will accept objections to its release of funds and Union County's certification received by February 2, 2015, or a period of 15 days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Union County; (b) Union County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by DCED; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Department of Community and Economic Development, Center for Community Building, 4th Floor Commonwealth Keystone Building, Harrisburg, PA 17120-0225.
