MARYLAND DEPARTMENT OF THE ENVIRONMENT WATER MANAGEMENT ADMINISTRATION NOTICE OF TENTATIVE DETERMINATION Allegany County Application for State Discharge Permit 13-DP-0567, NPDES Permit MD0021598: Mayor and City Council of Cumberland, 57 N. Liberty Street, Cumberland, Maryland 21502 applied for renewal of the permit to discharge an average of 15.0 million gallons per day (mgd) of treated domestic and industrial wastewater from the Cumberland Wastewater Treatment Plant located at 400 East Offutt Street in Cumberland to the North Branch Potomac River. The Department is proposing to reissue the permit for the facility with the following limitations: BOD5, 16 mg/l maximum monthly arithmetic mean and 24 mg/l maximum weekly arithmetic mean during May 1 through October 31, 30 mg/l maximum monthly arithmetic mean and 45 mg/l maximum weekly arithmetic mean during November 1 through April 30; total suspended solids, 30 mg/l maximum monthly arithmetic mean and 45 mg/l maximum weekly arithmetic mean and 1,370,502 lbs/yr maximum yearly load; ammonia nitrogen of 4.7 mg/l maximum monthly arithmetic mean from May 1 through October 31 and 15 mg/l maximum monthly arithmetic mean from November 1 through April 30; total nitrogen, 182,734 lbs/yr maximum yearly load; total phosphorus, 13,705 lbs/yr maximum yearly load; E. coli of 126 MPN/100 ml maximum monthly geometric mean; dissolved oxygen, 5.0 mg/l minimum at any time year round; total residual chlorine of 0.032 mg/l at any time and pH maintained between 6.5 and 8.5. Regular effluent monitoring and reporting are required. This permit is in conformance with the load allocation for segment POTTF_MD ( Potomac River Tidal Fresh Maryland) in the “Chesapeake Bay TMDL for Nitrogen, Phosphorus, and Sediment” established on December 29, 2010. A public hearing on the tentative determination will be scheduled if a written request is received by February 2, 2015. The request should be sent to the Maryland Department of the Environment, Water Management Administration, 1800 Washington Blvd., Baltimore, Maryland 21230-1708 Attn.: Mr. Yen-Der Cheng, Chief, Municipal Permits Division and must include the name, address and telephone number (home and work) of the person making the request, the name of any other party whom the person making the request may represent, and the name of the facility and permit number. Failure to request a hearing by February 2, 2015 will constitute a waiver of the right to a public hearing on the tentative determination. Written comments concerning the tentative determination will be considered in the preparation of a final determination if submitted to the Department, to the attention of Mr. Cheng at the above address, on or before February 12, 2015.
