STATE OF ALABAMA, CULLMAN COUNTY. NOTICE OF MORTGAGE FORECLOSURE SALE WHEREAS, on the 19th day of July, 2005, RONALD W. RANKIN AND JULIANNE J. RANKIN, husband and wife, did execute and deliver to CULLMAN SAVINGS BANK a mortgage on certain real estate hereinafter described, which mortgage appears of record in the Office of the Judge of Probate of Cullman County, Alabama, at Mortgage Book 1437, Page 146; and WHEREAS, default has been made in the performance of said mortgage as is provided therein, which default continues at this date, and said mortgage is subject to foreclosure. NOW THEREFORE, notice is hereby given that the undersigned, acting pursuant to the power contained in the aforesaid mortgage, will sell at public outcry to the highest bidder for cash at the entrance door of the Cullman County Courthouse in Cullman, Alabama, within the legal hours of sale on the 17th day of February 2015, the real estate described in said mortgage, being more particularly described as: Lot 24 of Clear Water Coves Subdivision, as recorded in Plat Book 2005, Pages 33 and 34, in the Probate Records of Cullman County, State of Alabama. Subject to the Restrictive Covenants of Clear Water Coves Subdivision as recorded in Misc. Book 225, Page 400, in the Office of the Judge of Probate, Cullman County, Alabama. Also, subject to easement to Alabama Power Company for water storage rights up to the 510’ water level of Smith Lake, and for overflow rights up to the 522’ water level as recorded in the Probate Office of Cullman County, Alabama, including the exclusive jurisdiction to regulate the permitting of any dock located or sought to be located on the subject property. THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF THE PROBATE WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT. SAID SALE will be made subject to the right of redemption of those entitled thereto under Alabama law and for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
