NOTICE OF SALE In obedience to an Order of Sale in the Probate and Family Court of Cumberland County, Crossville, TN, made in the case of Thomas McMahon vs. Megan Pflugner; Colleen Curry; Patrick McMahon; Kathleen Durso, and being Cause NO. 2016-CH-1074, I will on the 10th day of January, 2017, at the hour of 10:00 A.M., (Central Standard Time), sell to the highest and best bidder, the tract of land in said Order, on the premises, at 383 Green Meadow Drive, Sparta, Tennessee 38583, in Cumberland County, Tennessee. **Online bidding offered at www.taysauction.com* Online bidding will start with opening bid on December 6, 2016. Online bidding will close beginning 10:00 a.m. (CST), January 10,2017, with Tays Realty&Auction, LLC staff on location at 383 Green Meadow Drive, Sparta, Tennessee 38583 to conduct the conclusion of the auction. If during the final five minutes of this sale the highest bid is upset, the closing time will be extended by five minutes to allow the upset bidder of any other bidder to counter. The high bid will be held open on www.taysauction.com until January 20, 2017, at 4:00 p.m. (CST). Said high bid must be raised by no less than 10%. If the high bid is raised during the 10 day period, the online auction shall continue to accept bids until the bidding closes with further notice of date. The final bid will be tendered to the Court for confirmation. The tract of land in said order described is located in the EIGHTH Civil District of Cumberland County, Tennessee, more fully described as follows: BEGINNING on an iron pin found on the east margin of Green Meadow Road, Northeastward a distance approximately 1,630 feet from the intersection of Glade Creek Road, said iron pin a corner of Mrs. Kevin F. McMahon (Deed Book 523, Page 633) and Sylvester Nelson (Deed Book 1356, Page 1799) located on the north boundary of David and Darlene Bell (Deed Book 300, Page 400), this iron pin is on the 1983 Tennessee Grid at North= 604,037.503 feet and East= 2,193,873.721 feet, and is the southeast corner of the tract herein described; thence along Bell, North 85 deg. 23 min. 43 sec. West, crossing Green Meadow Road at 18 feet, in all a total distance of 93.13 feet to a 5/8 inch iron pin found in a electric transmission line, said iron pin a corner of Kathleen and Lawrence Durso (Deed Book 520, Page 644); thence along Durso, North 02 deg. 08 min. 17 sec. East, a distance of 423.82 feet to a 5/8 inch iron pin; thence North 03 deg. 38 min. 53 sec. East, a distance of 391.69 feet to a 5/8 inch iron pin found on the boundary of Plateau Properties (Deed Book 184, Page 462); thence South 62 deg. 29 min. 20 sec. East, a distance of 262.10 feet to a 5/8 inch iron pin found at a stone and fence post, a corner of Sylvester Nelson; thence South 07 deg. 19 min. 51 sec. West, a distance of 560.01 feet to a 5/8 inch iron pin at a steel fence post on the south edge of a gravel drive, a corner of Mrs. Kevin F. McMahon; thence along said drive, North 59 deg. 52 min. 01 sec. West, a distance of 65.73 feet to an iron pin set for this survey; thence North 58 deg. 30 min. 35 sec. West, a distance of 86.18 feet to an iron pin set at the extension of Green Meadow Road; thence along the east side of said road, South 57 deg. 59 min. 40 sec. West, a distance of 34.46 feet to an iron pin set for this survey; thence South 09 deg. 15 min. 23 sec. West, a distance of 60.31 feet to an iron pin set for this survey; thence South 05 deg/ 14 min. 44 sec. East, a distance of 142.51 feet to an iron pin set for this survey; thence South 12 deg. 33 min. 32 sec. East, a distance of 92.22 feet to the point of beginning, containing 3.39 acres according to a survey made August 17, 2016 by Michael V. Stump, RLS No. 784. Bearings recited in this description refer to Tennessee Grid North, coordinates derive from GPS observations. Said sale will be for the 20% cash in hand at the close of the bidding, with balance evidenced by promissory note, due and payable (10) days from date of the confirmation of sale.
