(Published In THE TIMES, Mayes County, Oklahoma January 8, 2017) TOWN OF SPAVINAW COUNTY OF MAYES STATE OF OKLAHOMA ORDINANCE NO. 2016-2 AN ORDINANCE SUBMITTING TO A VOTE OF THE REGISTERED VOTERS OF THE TOWN THE QUESTION OF PROVIDING FOR THE APPOINTMENT OF THE TOWN CLERK-TREASURER BY THE TOWN BOARD OF TRUSTEES; AMENDING SECTIONS 1-7A-1 (A) AND 1-7B-1 (A) OF THE TOWN CODE OF SPAVINAW, OKLAHOMA; PROVIDING FOR REPEALER AND SEVERABILITY; REQUIRING APPROVAL OF THIS ORDINANCE BY MAJORITY OF THE REGISTERED, QUALIFIED VOTERS OF THE TOWN VOTING ON AN ELECTION HELD FOR SUCH PURPOSE ON APRIL 4, 2017, AS PROVIDED BY LAW; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE; AND REQUIRING THE FULL TEXT BE PUBLISHED. Whereas, the Town Board of Trustees of the Town of Spavinaw, Oklahoma, pursuant to Town Ordinance (Town Code of Spavinaw, Oklahoma, Section 1-7-1 (B)) and State Law (Oklahoma Statutes Title 11 Section 16-207 (B) (1978)) desire to submit to a vote of the registered voters of the Town of Spavinaw, Oklahoma the question of whether the office of Town Clerk-Treasurer of the Town of Spavinaw, Oklahoma should be appointed by the Town Board of Trustees of the Town of Spavinaw, Oklahoma. Whereas, The Town Board of Trustees of the Town of Spavinaw, Oklahoma, pursuant to Oklahoma Statutes Title 11 Section 12-112 (1984), in Ordinance Number 2008-1, consolidate the offices and duties of the Town Clerk and Town Treasurer approving same on 03/11/2008 and publishing same according to law. BE IT ORDAINED by the Town Board of Trustees of the Town of Spavinaw, Oklahoma, as follows: Section 1. From and after the date of passage of this ordinance, Section 1-7A-1 (A) of the Town Code of the Town of Spavinaw, Oklahoma, shall be amended to read as follows: The Town Clerk-Treasurer shall be appointed by the Town Board of Trustees. Section 2. From and after the date of passage of this ordinance, Section 1-7B-1 (A) of the Town Code of the Town of Spavinaw, Oklahoma, shall be amended to read as follows: The Town Clerk-Treasurer shall be appointed by the Town Board of Trustees. Section 3. Repealer: All ordinances or parts of ordinances in conflict herewith, are, to the extent of such conflict, hereby repealed. Section 4. Severability: If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, said portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion of this ordinance. Section 5. Effective Date: This ordinance shall go into effect thirty (30) days after its final passage in accordance with Oklahoma Statutes Title 11 Section 14-103 (1984) and the appointive position shall take effect at the end of the current term of office (2019) according to Oklahoma Statutes Title 11 Section 16-207 (B) (1978), all subject to the approval of majority of the registered, qualified voters of the Town of Spavinaw voting on the same, to be held Tuesday, April 4, 2017, in the manner prescribed by law. Section 6. Full Text Published. This ordinance shall be published in its entirety in a legal newspaper with countywide circulation, as required by law (Oklahoma Statutes Title 11 Section 14-106).
