PUBLIC NOTICE Notice of Intent to Adopt Ordinance on final reading by the City Council of the City of Meadville. Notice is hereby given that on Wednesday, April 3, 2013 at a Regular meeting, a bill proposing the adoption of the following proposed ordinance was introduced to and considered by City Council of the City of Meadville on first and second reading. Notice is further given that the City Council of the City of Meadville intends to consider the said proposed ordinance on third and final reading at its Regular meeting scheduled for Wednesday, April 17, 2013 at 6:00 P.M. in the Council Chambers at the Meadville City Building, 894 Diamond Park, Meadville, Pennsylvania. The proposed ordinance may be finally passed at that time. BILL NO. 3 OF 2013 CITY OF MEADVILLE CRAWFORD COUNTY, PENNSYLVANIA AN ORDINANCE APPROPRIATING AND TRANSFERRING UNEXPENDED FUNDS AMONG SEVERAL ACCOUNTS OF THE 2012 GENERAL FUND, PARKING FUND AND CAPITAL IMPROVEMENT FUNDS OF THE CITY OF MEADVILLE FOR THE PURPOSE OF MEETING THE REMAINING 2012 FISCAL REQUIREMENTS OF THE CITY OF MEADVILLE, AND OF TRANSFERRING UNEXPENDED FUNDS FROM PREVIOUSLY APPROPRIATED ACCOUNTS, THE PURPOSES OF WHICH HAVE BEEN ACCOMPLISHED, ABANDONED OR REMAIN TO BE ACCOMPLISHED, TO THE RESPECTIVE 2013 GENERAL FUND, PARKING FUND AND CAPITAL IMPROVEMENT FUNDS OF THE CITY. Whereas, in the 2012 General Fund, Parking Fund and Capital Improvement Funds Budgets there are certain balances in accounts which were appropriated but not expended and certain Reserve Funds, the purposes of which have been accomplished or abandoned, containing unexpended balances; and certain funds which have been derived from an excess of receipts in anticipated revenues over expenditures; and Whereas, Council desires to transfer and appropriate all such balances to the appropriated and Special Reserve Accounts of the General Fund, Parking, and Capital Improvement Funds to meet the remaining 2012 fiscal obligations of the City and to provide for the transition of the remaining unexpended balances from the 2012 accounts to the 2013 budgeted accounts of the various funds referred to above. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Meadville, and it is hereby ordained and enacted as follows: Section 1. In order to provide for certain unanticipated expenditures from the General Fund, Parking Fund and Capital Improvement Funds of the 2012 Budget of the City of Meadville, for which no or insufficient appropriation was established, certain amounts are appropriated and transferred from certain accounts to other accounts within the respective General Fund, Parking Fund and Capital Improvement Funds of the 2012 Budget, all as set forth in the Schedule attached to this Ordinance, which Schedule is adopted and incorporated by reference. Section 2. All other funds appropriated but unexpended within the General Fund, Parking Fund and Capital Improvement Funds of the 2012 City Budget which are not specifically transferred to Reserve Accounts or encumbered and all funds received in excess of 2013 Revenues budgeted are hereby transferred to the Unappropriated Balances of the respective 2013 General Fund, Parking Fund and Capital Improvement Funds. Section 3. The unexpended funds within the unappropriated balance of the 2012 General Fund, Parking Fund and Capital Improvement Funds are hereby transferred to the respective and corresponding 2013 budgets for the General Fund, Parking Fund and Capital Improvement Funds of the City of Meadville. Section 4. The above transfers and appropriations are made under the authority of Article XVIII of the Third Class City Code, Act of June 23, 1931, P.L. 932, as amended, and the Optional Third Class City Charter Law, Act of July 15, 1957, P.L. 901, as amended, and the Charter and Ordinances of the City of Meadville. Section 5. Severability. Should any section, part or provision of this Ordinance be declared by appropriate authority to be unlawful or unconstitutional, all other terms, conditions, provisions and parts hereof, and of any Code of which this Ordinance may be or may be considered to be part, shall continue in full force and effect as if the provision declared to be unlawful or unconstitutional had been omitted as of the date of final enactment hereof. Section 6. Effective Date. The provisions of this ordinance shall become effective at 12:01 AM, prevailing time, on the 21st day after the date of final passage and enactment. Section 7. Repealer. All ordinances and parts of ordinances inconsistent herewith are hereby repealed.
