Lawrence D. Sheets, III, Lisa D. Sheets Dunfee and all other heirs, executors, assigns and successors in interest, either known or unknown, of Lawrence D. Sheets, Sr., and the estate of Lawrence D. Sheets, Sr., late of East Chicago, Indiana, Defendants. TO: All heirs, executors, assigns and successors in interest, either known or unknown, of Lawrence D. Sheets, Sr., and the estate of Lawrence D. Sheets, Sr., late of East Chicago, Indiana, Defendants. You are hereby notified that the above-named Plaintiffs have filed a Complaint against you at the above term and number in the Court of Common Pleas of Crawford County, Pennsylvania, averring that they are the sole and exclusive owners of the premises described as follows, free and clear of any claims you may have: Parcel owned by plaintiffs that is the subject matter of this controversy. ALL THAT CERTAIN piece or parcel of land situate in South Shenango Township, Crawford County, Commonwealth of Pennsylvania, being known as property tax ID number 4706-020 and being formerly bounded and described as follows: Seventy-five (75) acres, bounded on the North by Route 322; on the South by Lake-Ken; on the East by Erwin, and on the West by Kerr, J.H. Also more recently described by the attached survey of Henry B. Knapp, PLS, dated October 17, 2012 as follows: 81.9309 acres, more or less, beginning at a point in the centerline of U.S. Highway 322, at the northeast corner of lands now or formerly of Donald F. Cloud, Jr.; thence extending North 57° 41' East, along the centerline of U.S. Highway 322, for a distance of 1269.90 feet to a point at the northwest corner of lands now or formerly of Thomas Biles; thence South 01° 15' 30" West, along land now or formerly of Thomas Biles, passing through an iron pin found at the southern right-of-way line of U.S. Highway 322 a distance of 2637.33 feet to an iron pipe found; thence South 88° 54' East, along a tree line at the southern line of land now or formerly of Thomas Biles, for a distance of 1033.75 feet to a point where an iron pin was set; thence South 00° 40' 30" East, along land now or formerly of Randy Meadows, a distance of 992.31 feet to a point where an iron pin was set; ; thence South 89° 53' 10" West, along the centerline of an abandoned road at the Northern line of land now or formerly of Gary M. Chizmar, a distance of 1186.12 feet to a point where an iron pin was set; thence North 00° 26' East, along land now or formerly of Debora Witten, a distance of 507.54 feet to a point where an iron pin was set; thence North 00° 46' 15" East along land now or formerly of David Floch, a distance of 504.75 feet to a point where a survey stake was found; thence North 88° 53' 15" West along land now or formerly of David Floch a distance of 897.11 feet to a point where the northern line of lands now or formerly of David Floch meets the Southeast corner of lands now or formerly of Donald E. Cloud, Jr. where an iron pin was found; thence North 00° 21' 05" East along land now or formerly of Donald F. Cloud Jr., a distance of 1937.90 feet passing through an iron pin found along the Southern line of U.S. Highway 322, to the point and place of beginning. BEING the same land conveyed to Bretton Walberg and Stacey Walberg by deed dated November 26, 2012, from Angelo Cappas and Mary Cappas, husband and wife, and recorded in Crawford County Record Book 1110, Page 1168. The plaintiffs further aver that any interest that has been held or owned by the defendants in the past in the nature of a reserved one-half interest in the oil, gas and mineral rights in and under the afore described property has been extinguished by operation of law of a Tax Claim Sale by the Treasurer of Crawford County in 1966 and a subsequent deed from him on August 2, 1966, when the afore described unseated lands were sold for unpaid taxes by Wallace C. Dean, Treasurer of Crawford County, to Angelo Cappas. Said deed recorded in Treasurers Deed Book 10, Page 240, and Deed Book 444, Page 230, and said previously reserved one-half interest in oil, gas and mineral rights would have been divested by the ruling in Proctor versus Sagamore Big Game Club, 166 F.Supp. 465 (1958) affirmed 265 F.2d 196 and the plaintiffs have requested relief which, if granted, would prevent the defendants from ever asserting any claim or ownership or rights of any kind in the above described property unless the defendants properly asset their rights within 20 days from the date of this notice. NOTICE If you wish to defend, you must enter a written appearance personally or by an attorney and file your defenses or objections in writing with the court. You are warned that if you fail to do so, the case may proceed without you and a judgment may be entered against you without further notice for the relief requested by the Plaintiff.
