HOUK, DECEASED, Defendant.SUMMONS BY PUBLICATION COMES NOW the Plaintiff, U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for REO Trust 2017-RPL1 ("U.S. Bank"), by counsel, having filed its Complaint and Affidavit in the above-entitled cause, hereby requests that the Clerk of Madison Superior Court, issue the Summons by publication as follows: 1.This Summons by publication is specifically directed to Defendant, Unknown Heirs of William E. Houk, Deceased, whose last known address(es) and his/her present address(es) is/are unknown. 2.The nature of the above-captioned cause is that on March 20, 2000, William E. Houk executed and delivered to U.S. Bank a certain Loan Repayment and Security Agreement (the "Note") by which he promised to pay to the order of U.S. Bank the sum of $54,261.54, together with interest and as of August 2, 2018, there is a principal balance owing in the amount of $54,264.54. 3.To secure payment of the Note, William E. Houk executed and delivered to U.S. Bank a Mortgage upon certain real estate (the "Mortgage"), said Mortgage being executed on March 20, 2000. The real estate, which is the subject matter of this cause, is described as follows, to-wit: LOT NUMBERED 38, IN GLEN ELLYN ADDITION TO THE CITY OF ANDERSON. ADDRESS: 607 COVENTRY DRIVE; ANDERSON, IN 46012 TAX MAP OR PARCEL ID NO.: 18-4023700, More commonly known as 607 Coventry Drive, Anderson, Indiana 46012, (the "Real Estate"). 4.U.S. Bank, as the holder of the Note and assignee of the Mortgage, has accelerated the entire balance due and owing on the Note and Mortgage, due to William E. Houk's failure to make the required payments and is also responsible for prejudgment interest as set forth in the Note and reasonable attorney fees. 5.The Defendant, Unknown Heirs of William E. Houk, Deceased, named herein must answer this Summons in writing, personally or by counsel, on or before thirty (30) days from the date of the third publication hereof.
