NOTICE TO TAXPAYERS AND ALL OTHER PERSONS AFFECTED BY THE ADOPTION AND CONTENT OF RESOLUTIONS OF THE KOKOMO REDEVELOPMENT COMMISSION AND NOTICE OF PUBLIC HEARING ON CONFIRMATORY RESOLUTION Taxpayers of the Kokomo Redevelopment District (the "District") and all other persons affected hereby are notified that the Kokomo Redevelopment Commission (the "Commission") has met and adopted Resolution No. 2018-1 on July 10, 2018, amending (a) Declaratory Resolution No. 2010-3, as amended and supplemented, regarding the Wildcat Redevelopment Area, and (b) Declaratory Resolution No. 2015-1, as amended and supplemented, regarding the Southeast Economic Development Area (collectively, the "Areas") (the "Amendatory Resolution") to (i) consolidate the Downtown Area and the Southeast Area into the "Consolidated Downtown-Southeast Economic Development Area" as described therein (the "Consolidated Downtown-Southeast Area"), (ii) consolidate the Redevelopment Plan for the Downtown Area and the Economic Development Plan for the Southeast Area (the "Consolidated Downtown-Southeast Plan"), (iii) expand the boundaries of the Consolidated Downtown-Southeast Area by identifying and including certain parcels into the Consolidated Downtown-Southeast Area, as described therein (the "Expanded Consolidated Area"), (iv) designate the Consolidated Downtown-Southeast Area and the Expanded Consolidated Area as an allocation area to be known as the Expanded Consolidated Allocation Area as required by Indiana Code 36-7-14-39, (v) designate the Downtown Allocation Area, the Southeast Allocation Area and the Expanded Consolidated Allocation Area as sub-allocation areas of the Consolidated Downtown-Southeast Allocation as provided and as described therein, and (vi) add certain projects to the Consolidated Plan within the Consolidated Downtown-Southeast Area (the "Projects") which are made apart of the Consolidated Downtown-Southeast Area, as the addition of the Projects will assist the Commission in implementing the Consolidated Plan, all in accordance with Indiana Code 36-7-14-17.5 (collectively, the "Amendment"), all in accordance with Indiana Code 36-7-14 and Indiana Code 36-7-25 (the "Act"). The District will continue to use incremental property taxes levied and collected in the Areas, as consolidated and expanded, in accordance with the Act, to finance the construction of certain public and private projects, convention center, hotel, street, park, trail, infrastructure and other improvements and to pay debt service on obligations which may be issued to finance the projects, in addition to incremental real and personal property taxes collected in the Areas as contemplated by the Amendatory Resolution. The Amendatory Resolution, the Consolidated Plan, and supporting data, including maps and plats describing the Consolidated Downtown-Southeast Area, the Expanded Consolidated Area and the sub-allocation areas designated within the Areas as consolidated and expanded, have been prepared and can be inspected at the Office of the City Clerk, in the City of Kokomo, Indiana. Notice is further given that the Commission on August 13, 2018, at 4:00 p.m., local time, in the City Hall, Louks Conference Room, First Floor, 100 South Union Street, Kokomo, Indiana 46901, will receive and hear remonstrations from persons interested in or affected by the proceedings pertaining to the proposed Amendatory Resolution and will determine the public utility and benefit of the proposed Amendment. At the time fixed for hearing, or at any time prior thereto, any person interested in the proceedings may file a written remonstrance with the Secretary of the Commission. At such hearing, which may be adjourned from time to time, the Commission will hear all persons interested in the proceedings and all remonstrances that have been filed. After considering this evidence, the Commission will take final action by either confirming, modifying and confirming, or rescinding the Amendatory Resolution. CITY OF JOHNSTOWN, PA COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS (FONSI-RROF) PUBLICATION DATE: August 2, 2018 GRANTEE NAME: City of Johnstown, PA GRANTEE ADDRESS: 401 Main Street, Johnstown, PA 15901 TELEPHONE: (814) 533-2017 TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS: The purpose of this notice is to satisfy two (2) separate but related procedural requirements for an activity to be undertaken by the City of Johnstown, PA. REQUEST FOR RELEASE OF FUNDS On or about August 20, 2018, the City of Johnstown will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended (P.L. 93-383), to undertake projects funded by the FY 2017 CDBG Program for the purpose of emergency housing rehabilitation in the City of Johnstown, PA. An environmental review strategy has been prepared and it has been determined that the only applicable site specific 24 CFR 58.5 and 58.6 requirements for the subject projects listed below are: historic preservation, toxic substances, noise abatement and control, and floodplain management. Each site shall be reviewed in accordance with these factors, with compliance fully documented, before approving any specific loans or grants. Site specific projects determined to exceed one or more of the environmental constraints established for the program will require a separate environmental review. CATEGORICALLY EXCLUDED PROJECT Emergency Rehabilitation Ð Funds will be used for emergency housing rehabilitation. The City will issue deferred loans up to a maximum of $5,000. This is a multi-year activity. The FY 2017 CDBG budget is $20,000. The FY 2017 through FY 2019 budget is estimated to be $60,000. The above activity may extend beyond one fiscal year and may require funding from future program years. FINDING OF NO SIGNIFICANT IMPACT (FONSI) The City of Johnstown has determined that the above-identified projects will have no significant impact on the human environment. Therefore, an Environment Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Johnstown Department of Community and Economic Development, 401 Main Street, Johnstown, PA 15901, and is available for public examination and copying, upon request, during normal business hours Monday through Friday, 8:30 AM to 4:30 PM. The activity listed above is categorically excluded under HUD regulations at 24 CFR Part 58 of the National Environmental Policy Act (NEPA) requirements. Additional project information is contained in the respective project ERR on file and is available for review or copying at the same location and time specified in the preceding FONSI statement. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Johnstown Department of Community and Economic Development, 401 Main Street, Johnstown, PA 15901. All comments received by August 17, 2018 will be considered by the City of Johnstown prior to authorizing submittal of a request for release of funds. Commenters should specify which part of this Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Johnstown certifies to HUD that the Hon. Frank Janakovic, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and these responsibilities have been satisfied. HUDÕs approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Johnstown to use CDBG funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of JohnstownÕs certification received by September 4, 2018, or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the City of Johnstown; (b) the City of Johnstown has omitted a step or failed to make a decision or finding required by HUD regulations are 24 CFR Part 58; (c) the City of Johnstown or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the projects are unsatisfactory from the standpoint of environmental quality. CDBG-D NFP FP Area IV Agency on Aging and Community Action Programs, Inc. - Notice of Intent to Request a Release of Funds (Categorically Excluded Activity) NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS July 26, 2018 Indiana Housing and Community Development Authority (IHCDA) 30 South Meridian St., Suite 1000 Indianapolis, IN 46204 (317) 232-7777 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Area IV Agency on Aging and Community Action Programs, Inc. On or about August 9, 2018 the IHCDA will authorize AREA IV AGENCY ON AGING AND COMMUNITY ACTION PROGRAMS, INC. to submit a request to HUD the administering agency for the release of Community Development Block Grant (CDBG) Disaster Relief funds under Title I of the Housing and Community Development Act of 1974, as amended, and enabled under Public Laws 110-252 and 110-329, to undertake a project known as: Project title: Lead Community Action Program Purpose/Scope of Project: To oversee risk assessments for 15 owner-occupied units and conduct lead hazard control (interim controls and/or abatement) activities in approximately 15 owner-occupied housing units. Estimated funding: $300,000.00 Project location if applicable: Boone County, Carroll County, Tippecanoe County and White County The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the IHCDA, 30 South Meridian St., Suite 1000, Indianapolis, IN 46204 and can be examined or copied weekdays 8 A.M. to 5 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to IHCDA, 30 South Meridian St., Suite 1000, Indianapolis, IN 46204. All comments received August 31, 2018 will be considered by the IHCDA prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS The IHCDA certifies to HUD that Jacob Sipe in her capacity as Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows AREA IV AGENCY ON AGING AND COMMUNITY ACTION PROGRAMS, INC. to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the IHCDA's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the IHCDA; (b) the IHCDA has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) AREA IV AGENCY ON AGING AND COMMUNITY ACTION PROGRAMS, INC. has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD Office of Community Planning and Development, Attn: John Dorgan, Director of Community, Planning and Development, Minton Capehart Federal Building, 575 North Pennsylvania Street, Room 655, Indianapolis, IN 46204.
