Update - 2017 DNR Administrative Order – The DNR’s Administrative Order issued in 2017 has been finished. The weekly photo log requirement from DNR has been satisfied. I do have one minor item under Emergency Business this evening. ENGINEER SITE REPORT –Kevin Jensen of Barker Lemar Engineering – Biggest item tonight is the airspace survey. The survey revealed density remained about the same and remaining airspace is about 3.7 years or about February 2022. So construction would need to be in 2021. Clinton: This is estimating the remaining cell life? Jensen: Yes. Clinton: Single Stream and reduced intake could impact this. That could increase the amount of time in the cell. When do you perform another airspace survey? Jensen: Performed annually or sooner if requested. Compaction and tonnage affect that number. LANDFILL OPERATIONS REPORT – Jeff Rittmer of Rittmer, Inc. – Everything is going well. No issues. Have been utilizing the tarps. DeWitt: How many tons over the 2100 were we last month? Seward: About 1800 tons. DeWitt: What was the overage amount paid before? Seward: $6 more per ton vs. $3 more per ton by Rittmer. DeWitt: Overages will be less now. So we should be saving a little money. COMMUNICATIONS FROM ANY AGENCY MEMBERS OR THEIR CONSTITUENTS: None UNFINISHED BUSINESS A. Discussion and Possible Action: 28E Agreement – Seward: The meeting for the Mayors of the 28E members took place in DeWitt on July 31st. Not all communities attended. I spoke with Shawn Hamerlinck from the Board of Supervisors. He indicated to me that the Supervisors will need a 28 E document approved by our legal counsel in order to approve it. Camanche: I want this done within a week so we can move forward on this. Clinton: City Admin. Matt Brooke will be sending out a “fixed” 28 E agreement document because of the change in the tax levy. We originally had it at $215 thousand dollars. Now it will reflect the 7 cents per thousand number. Seward: Logistically, I can’t send this Attorney Peavey without having the updated copy. Clinton: I will have Brooke send that tomorrow. Seward: Once I received it I will forward to Peavey. Clinton: Hamerlinck also said that he has to talk to all other cities that did not participate in the DeWitt meeting. I was hoping this would move a little quicker. I’m actually taking this to the Clinton City Council Committee of Whole meeting Tuesday to be prepared to approve this. Camanche: I will probably give this to the Camanche City Council, too. DeWitt: We’ve already sent it out to the council for review. DeWitt: I would like to put on the calendar for next month the tipping fee discussion. Can we put that on new business for next month? Let’s just keep moving forward. B. Contract Operator Transition – Potential Action – Seward: A letter went out to Progress Contracts from John Peavey’s office on our behalf. The letter was dated July 18th. It stated that Progress has 30 days to rectify final grading according to contract and DNR, removal of contractors’ possessions, repair of the landfill liner caused by contractor, and repair of tarp machine. It stated that approximately $39 thousand has been retained by the agency and work not completed within 30 days will offset the retainage. Brock Swan of Progress Contracts indicated to me that the white barn is empty. The trailers and trucks will be moved from around the white barn next week. His off road dump truck will be hauled out next week. His operational dump truck had transmission and radiator problems and has been in for repairs the past two weeks. So no dirt has been moved in that time. Tarp repairs cost $1900. That does not count labor costs. Labor was $2420 for Rittmer for retrieval and repair. DeWitt: With the 18th approaching and equipment issues, is Progress going to be able to finish the work? Seward: My guess is no. Andover: How much dirt must be placed? Seward: 18 inches of intermediate cover. DeWitt: What we have is $52 thousand dollars, which I view as a forfeiture if the work is not done by the 18th. Clinton County made a motion to send a bill for the tarp and labor. Seconded by Charlotte. Clinton: What about the liner? Seward: Liner has not been fixed. Barker Lemar needs to conduct an assessment. Kevin Jensen: Basically need to get in there, move some dirt cleared away first and take a look at it. It’s likely going to take a GCL crew to come in and weld onto that material. Then final dirt work would take place. Clinton: Have we contacted our insurance company? Seward: We have. They do not cover the liner. Clinton: Does he have insurance? Seward: He does have insurance. We have not filed a claim against his insurance. We will. Andover: Is there anything else that has been damaged that you can turn in a claim against? Seward: Not that we have found. Clinton: We’re going to run out of retainage money. Transfer Trailer Proposals MEMO Nathan Klett from Foth has been working to prepare these trailer proposals. The compactor drawings were delayed and then there were delays in getting the bids back from the subcontractors in the trailer building process. Both bids received to this point are both Mac Trailers so there is not much a whole lot of variation in the bids yet. So Nate and I think it would be best to get the other bids in. Prices on the two bids received already will be held until September 3rd. Travis Trailers and East Trailers also included, but no bids back. Andover: Isn’t this a standard walking floor trailer. Iowa Code 400 requires that previous years of service are reflected in the Police Chief’s and Fire Chief’s contracts. The salary was also increased about $1,500 to make it more competitive with what other Chiefs are paid. Moved by Weller, second by Varner to approve the Department Head Contract for Police Chief Colin Reid. On roll call – all ayes. Kida stated that Public Works Director Mark Hilgendorf informed him that the driveway access to Well House #5 on 4th Avenue is in rough shape. The funding for repairs will come from the water fund. Going forward, he will work on a plan for drives and parking lots to seal coat them to extend their life. This project will also widen the driveway for better access. Moved by Varner, Second by Weller to approve a proposal from Determann Asphalt Paving, LLC to repair driveway access to Well House #5 on 4th Avenue $10,837.50. On roll call – all ayes. Kida and Chief Reid discussed the new police squad car. The funding comes from the equipment fund for which the Police Department budgets each year. Vehicles are replaced on a rotation and are lasting longer due to the maintenance done by our staff. The new vehicle will be an SUV and is the fourth marked squad car. Kida led a discussion regarding the need for repairs to the salt shed which includes building a berm to shore up the building. The property owners next to the shed do not want a berm on their property so we had to have a survey done on the 25’ strip of land. They now also want a real estate assessment of the land to determine the current cash value. Discussion of the repairs to the shed followed. The project will be paid from the Road Use fund. Moved by Metzger, second by Weller to approve payment to Landmark Engineering for Retracement Survey at 409 4th Avenue for salt shed repairs $4,532.50. On roll call – all ayes. Kida discussed the Two Year Street Improvement Plan developed by Kida after he and Hilgendorf drove around the city to assess the condition of the streets. The plan is two phases so we can put each phase out for bid separately. The money is in the Road Use fund but we will need to amend the budget to complete the projects. He will later work toward a five year plan as well as a strategic plan for the city. The Mayor and Council commended Kida and Hilgendorf for their work on the plan. Kida said the plan is posted on our website. Moved by Metzger, second by Brightman to approve City of Camanche Two Year Street Improvement Plan. On roll call – all ayes. Kida led a discussion on the bathrooms at Platt Park. The building was constructed in the mid 1970’s with REAP grant money before the ADA existed. We are now requesting REAP Grant funding to replace the building with an ADA compliant facility. The $154,800.00 cost includes demolition of the old building and construction of a new building in the same general area the existing one is located. Once we are approved for the grant, we would pay for the project then the DNR would reimburse us. The work would not begin until the grant is approved and the drawings will go through the Park and Recreation Commission. Moved by Metzger, second by Varner to approve the application for IDNR REAP Grant to upgrade the bathrooms at Platt Park. On roll call – all ayes. Hilgendorf discussed the generator at the 9th Street Lift Station which is a 1955 model and it picks up a good portion of the town. He found a grant to help pay for a back-up generator and is seeking approval to apply for the grant. The money won’t be disbursed until 2020. Brightman asked if the current generator will limp along in the meantime; Hilgendorf believes it will last. Moved by Metzger, second by Weller to authorize Public Works Director to apply for an Emergency Management grant to pay 50% of the cost (cost is approximately $32,500) of a backup generator at the 9th Street Lift Station. On roll call – all ayes. Chief Reid read the Camanche Police Department July Report and Chief Schutte read the Camanche Fire Department July Report. Kida discussed the Canadian Pacific Railway project at the 7th Avenue crossing. It is a project that was approved a few years ago and was recently finished. The initial payment was made in October 2017. Mayor Willis stated that back in 2000 there were several accidents at the 7th Avenue crossing so the City applied for a grant from the Canadian Pacific to have crossing arms installed. It took until 2015 for ours to come to the top of the pile. This is the final payment on the project. Moved by Metzger, second by Weller to approve payment to Canadian Pacific Railway final bill for CP Project 125392 7th Avenue crossing, City share $6,407.99. On roll call – all ayes. Kida asked members of the Council who are interested in attending League of Cities in Council Bluffs in September to let him know. Metzger said it would be especially beneficial for new members of the Council to attend. He informed everyone that he put into the RPA to get solar powered flashing crosswalk signs for 7th Avenue and Washington Boulevard. He also applauded the Park and Recreation Commission and Linda Putman for their work on the ADA Transition plan. It will come to Council for approval at the next meeting. Mayor Willis stated we had another successful Camanche Days. Metzger complimented the Camanche Days volunteers and also the Fire Department for a successful Pancake Breakfast. She has seen a lot of positive feedback on Facebook about the Police department; she appreciates their efforts and community involvement. She also mentioned that, regarding social media, that we should all think before hitting post. She asked about the dog park; Kida and Mayor Willis are still discussing land options. She also asked that golf carts be put on the next agenda. Varner thanked the Police Department, Fire Department and Public Works for a great Camanche Days. He also informed everyone that today is National Purple Heart Recognition Day. -13- Campie agreed that Camanche Days was great. She stated that the Park and Recreation Commission approved the ADA Transition Plan. She asked about Swan Drive. Mayor Willis said the people there aren’t ready to do anything yet. We will pay for our portion whenever the residents are ready to do the project. She also asked about the SRO program. Kida said there is more research and work being done. He will send more information to Council. Campie also asked about Kid’s First Academy. Kida said that building belongs to the City and Kid’s First is current on their payments. Brightman went to the motivational speaker program about three weeks ago. It was very good and the main topic he heard on was hearsay. He got a lot from the speaker. Chief Schutte submitted the CCDA grant application. He thanked the community for their support of the pancake breakfast; they served over 1,100 people. The fish fry is this Saturday and the door to door drive will be August 29th. He also said, regarding the Fourth of July, he would not change anything. Today is Greg Nelson’s 35thanniversary as a volunteer. Chief Reid said the Civil Service testing was done. He said he had fewer calls for service on the fourth of July and Camanche Days was successful from a police perspective. Kida stated that the Garner Hall demo will be August 15, 2018. All full-time police and fire personnel who already reside within the sState at the time of hire shall reside within air ten (10) air miles of their place of employment within one (1) year after their first day of work, and must maintain residency within ten (10) air miles of their place of employment throughout their period of employment with the Ccity. (B) All full-time Ccity employees, except police and fire personnel, employed by the city after May 1, 2018, must reside within the municipal limits of the City of Clinton. Any such sign or banner shall be approved by City Administrator stating the reasons why the sign or banner complies with this ordinance, the dates during which the sign or banner may be hung, the exact location and height of the sign or banner, and an exhibit depicting the sign or banner proposed. Purpose. The purpose of this Ordinance is to amend Chapter 115 of the Code of Ordinances concerning massage therapists and massage therapy businesses. Section 2. Amendment. The Code of Ordinances of the City of Clinton, Iowa is amended by replacing the stated language in the applicable sections as follows: § 115.03 COMPLIANCE REQUIRED. No person shall operate, own, conduct, carry on or permit to be operated, owned, conducted or carried on any massage therapy business of any type or kind, including but not limited to any massage business or service offered in conjunction with or as part of any health club, health spa, resort or health resort, gymnasium, athletic club or other business without compliance with Iowa Code § 152C (providing for licensing and massage therapists and related requirements) and the provisions of this chapter. (1999 Code, § 125.03) Penalty, see § 115.99 § 115.04 EXCEPTIONS. The following businesses are excluded from the operation of this chapter: (A) Businesses operated by persons licensed by the state under the provisions of the Iowa Code Chapters 148 (licensed doctors/ surgeons, osteopathic doctors/ surgeons), 148A (licensed physical therapists), 148B (licensed occupational therapists), 148C (licensed physicians assistants), 149 (licensed podiatrists), (xx150A (osteopathsxx), 151 (licensed chiropractors), 152 (licensed nurses working under direction of licensed physician), 152B (licensed respiratory therapists working under direction of a licensed physician), 157 (licensed cosmetologists) or 158 (licensed barbers), when performing massage therapy or massage services as part of the profession or trade for which licensed; § 115.05 MASSAGE THERAPY BUSINESS PERMITS. (A) Generally. No person shall operate, own, conduct, carry on or permit to be operated, owned, conducted or carried on any massage therapy business in the city unless the premises at which the business is located meets the minimum standards set forth in § 115.10 of this chapter and unless a permit to operate a massage therapy business is obtained from the city in compliance with the provisions of this section. The annual permit fee is $25 per business location and is not refundable. The Fire, Health and Police Departments shall have the right to inspect the massage therapy business establishment at any time to determine whether there is compliance with the terms of this chapter. Section 3.Repealer. All other sections of this Ordinance in conflict with these provisions shall be repealed. Section 4. Severability. Hamerlinck, Chairperson UNFINISHED BUSINESS GENERAL PUBLIC DEPARTMENT HEADS, ELECTED OFFICIALS AND EMPLOYEES County Auditor Eric Van Lancker reported he has sent a letter concerning yard sign placement to candidates who will appear on the November ballot in Clinton County. He said several officials were receiving complaints about sign placement. He reminded the Board that a canvass of votes for the August 7th Special Elections will be scheduled for 9:00 a.m. next week. County Emergency Management Director Chance Kness updated the Board about the ME-transport program. He said a van has been purchased and interviews continue to fill the vacancies for transporters. County Engineer Todd Kinney reported on pavement condition reports. Supervisor Determann said Union Pacific recently hosted a meeting about the railroad bridge in Clinton that travels over the Mississippi River. He said it was mostly an update about how the project was initiated and it would hopefully start in 2020. He also said that the Low Moor project must be done before the bridge opens. Chairperson Hamerlinck said the Mental Health Region will meet today to discuss how counties will request funds from the Region. He said a Solid Waste Agency Board meeting will be Thursday. He said that meeting will review last week’s meeting concerning the proposed 28E agreement. DISCUSSION WITH POSSIBLE ACTION Law Enforcement Center project update: County Facilities Director Corey Johnson reported most of the steel in the front of the building has been set. He said the storage at the baseball stadium will be removed by the time the City begins working on that parking lot. Johnson said the roof is still on schedule to be installed before winter. Srp has been asked about tours being available. Johnson said they talked about media once the first floor is poured. Beacon services contract: Supervisor Srp and Van Lancker reported the Beacon services agreement has been sent to the County for the Board’s approval. The five-year contract is $8,460 per year for the next five years. Van Lancker said the contract may be cancelled at anytime with a 30-day notice without further financial obligation. Srp said Beacon offers features that County departments may use that the software the County Assessor has decided to change to does not have. County mileage reimbursement: Supervisor Srp said he recently learned that County employees can no longer claim the difference between the County mileage reimbursement rate of 39-cents and the federal rate of 54.5-cents on an individual’s income tax return. Van Lancker said he confirmed that with a local tax professional. Hamerlinck said he would support it as it is a fair thing to do for the employees. He asked the change be presented in a resolution next week for discussion. Published: August 17, 2018 ------ NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING City of Clinton, Iowa “Project W-2018, Grant Street Storm Sewer” Time and Place for Filing Sealed Proposals Sealed bids for the work comprising the improvements described below must be filed before 2:00 P.M. according to the clock in the office of the City Clerk on the 30th day of August, 2018, at the reception desk in City Hall, 611 South Third Street, Clinton, Iowa. Bids received after the deadline for submission of bids as stated herein shall not be considered and shall be returned to the late bidder unopened. General Nature of the Public Improvement The Grant Street Storm Sewer project will incorporate the construction of two new catch basins, an asphalt road patch, concrete road patch, asphalt road patch, replacement sidewalk and nearly five-hundred linear feet of pipe installation. The pipe installation runs parallel to the rail road tracks at this location. Railroad right of way extends 25 feet from the centerline of the tracks while the city right of way along this corridor is 80 feet wide. There is about 5 feet of space before a potential conflict between the railroad right-of-way and City right-of-way. This will allow the contractor enough space to install the pipe. The City will work with the property owner to obtain an easement while the work is occurring however, prior to the start of work a temporary fence, incidental to the project shall be installed to provide a barrier between the construction site and the railroad right-of-way. Upon completion of the project, surface restoration will be performed along the entire length of installed pipe and across the 30 foot easement. Preference of Products By virtue of statutory authority, preference will be given to products and provisions grown and coal produced within the State of Iowa.
