ORDINANCE NO. 1410 AN ORDINANCE TO AMEND TITLE 10, CHAPTER 10.48, ÒPARKING REGULATIONS GENERALLY,Ó OF THE MUNICIPAL CODE OF THE CITY OF OSKALOOSA, IOWA. BE IT ENACTED by the City Council of the City of Oskaloosa, Iowa: SECTION 1. Section 10.48.030 Ð ÒAngle parking.Ó is repealed and the following is enacted in lieu thereof: 10.48.30- Angle parking. Angle or diagonal parking shall be permitted only in locations marked as angle parking by the city. SECTION 2. Section 10.48.040 Ð ÒAngle parking - Manner.Ó is repealed and the following is enacted in lieu thereof: 10.48.040 - Angle parkingÑManner. Upon those streets or portions of streets which have been signed or marked for angle parking, no person shall park or stand a vehicle other than at an angle to the curb or edge of the roadway as indicated by such signs and markings. OSKALOOSA CITY COUNCIL REGULAR MEETING August 20, 2018 The Oskaloosa City Council met in regular session on Monday, August 20, 2018, at 6:00 p.m. with Mayor Krutzfeldt presiding and the following members answering roll call: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates. Absent: None. Mayor Krutzfeldt administered the Oath of Office to new Police Officer Justin DeKleine. Lisa McConnell, SIEDA, addressed City Council regarding a parks policy for tobacco and nicotine free parks and trails. It was moved by Moore, seconded by Walling to approve the consent agenda: August 6, 2018 City Council Regular Meeting Minutes August 20, 2018 Agenda Receive and file the following reports and communications from advisory and operating boards and commissions: July 23, 2018 Library Board Minutes August 7, 2018 Planning and Zoning Commission Minutes July 9, 2018 Water Board Minutes Payment of claims for training expenses for new police officer Justin DeKleine. Receive and file financial reports for July 2018. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said motion approved. It was moved by Moore, seconded by Walling to approve Pay Application No. 4 in the amount of $29,415.81 to Visu-Sewer, Inc. for Division 2 of the Phase 1 Sanitary Sewer System Improvements Project. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said motion approved. It was moved by Moore, seconded by Walling to approve Pay Application No. 2 in the amount of $122,622.58 to Visu-Sewer, Inc. for Division 2 of the Phase 2 Sanitary Sewer System Improvements Project. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said motion approved. Moore introduced Resolution No. 18-08-138 entitled ÒRESOLUTION ADOPTING SUPPLEMENT TO THE OSKALOOSA MUNICIPAL CODE OF ORDINANCES THROUGH ORDINANCE NO. 1407Ó and moved its approval. Walling seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Moore introduced Resolution No. 18-08-139 entitled ÒRESOLUTION SCHEDULING A TIME FOR HEARING FOR CONSIDERING THE MATTER OF LEVYING A SPECIAL ASSESSMENT AGAINST PRIVATE PROPERTY FOR WEED CUTTING BY THE CITY IN ACCORDANCE WITH SECTION 8.20 OF THE CITY CODE OF THE CITY OF OSKALOOSA, IOWA, AND DIRECTING NOTICE TO THE OWNER OF THE PROPERTY TO BE ASSESSEDÓ and moved its approval. Walling seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Moore introduced Resolution No. 18-08-140 entitled ÒRESOLUTION TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE PROPERTY OWNER OF 1705 SOUTH 5TH STREETÓ and moved its approval. Walling seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Moore introduced ÒAN ORDINANCE TO AMEND TITLE 10, CHAPTER 10.48, ÒPARKING REGULATIONS GENERALLY,Ó OF THE MUNICIPAL CODE OF THE CITY OF OSKALOOSA, IOWAÓ and moved its approval on the third reading. Walling seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said ordinance duly adopted. The ordinance was assigned No. 1410. The Mayor announced this is the time and place for the public hearing on levying a special assessment against private property for cutting and removal of weeds by the city of Oskaloosa, Iowa, and that citizens would now have the opportunity to comment. No oral or written comments were received. The Mayor declared said hearing closed. Moore introduced Resolution No. 18-08-141 entitled ÒRESOLUTION LEVYING A SPECIAL ASSESSMENT AGAINST PRIVATE PROPERTY FOR CUTTING AND REMOVAL OF WEEDS BY THE CITY OF OSKALOOSA, IOWA, IN ACCORDANCE WITH TITLE 8, CHAPTER 8.20 OF THE CITY CODE OF THE CITY OF OSKALOOSA, IOWAÓ and moved its approval. Yates seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. The Mayor announced this is the time and place for the public hearing on the vacation and sale of the 16.5 foot by 60 foot section of the east-west alley adjacent to 601 4th Avenue East and that citizens would now have the opportunity to comment. No oral or written comments were received. The Mayor declared said hearing closed. Moore introduced Resolution No. 18-08-142 entitled ÒRESOLUTION APPROVING QUIT CLAIM DEED AND VACATING THE EAST-WEST PUBLIC ALLEY ADJACENT TO 601 4TH AVENUE EASTÓ and moved its approval. Ottosson seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. The Mayor announced this is the time and place for the public hearing on accepting the bid and approving the conveyance of city-owned property located at 1214 1st Avenue West and that citizens would now have the opportunity to comment. No oral or written comments were received. The Mayor declared said hearing closed. Caligiuri introduced Resolution No. 18-08-143 entitled ÒRESOLUTION ACCEPTING THE BID AND APPROVING THE CONVEYANCE OF CITY-OWNED PROPERTY LOCATED AT 1214 1ST AVENUE WEST FOR $500 TO MAHASKA COUNTY HABITAT FOR HUMANITYÓ and moved its approval. Moore seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Walling introduced Resolution No. 18-08-144 entitled ÒRESOLUTION APPROVING THE PRELIMINARY PLAT OF THE GATEWAY COMMERICAL PARK SUBDIVISONÓ with removal of stipulation No. 1, and moved its approval. Burnett seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Lee Alexander addressed City Council regarding his plans for development at 208 A Avenue West. Caligiuri introduced Resolution No. 18-08-145 entitled ÒRESOLUTION APPROVING THE SITE PLAN FOR THE DEVELOPMENT OF THE ALEXANDER LAUNDRY PROJECT LOCATED AT 208 A AVENUE WESTÓ and moved its approval. Drost seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Burnett introduced Resolution No. 18-08-146 entitled ÒRESOLUTION APPROVING THE SITE PLAN FOR THE DEVELOPMENT OF THE BURRELL APARTMENT COMPLEX PROJECT LOCATED AT 1315 B AVENUE WESTÓ and moved its approval. Walling seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Brad Grefe, Area 15 Regional Planning Commission, gave a presentation on the Faade Improvement Project. It was moved by Caligiuri, seconded by Drost to approve payment of $28,601.53 to Christner Contracting Inc., $287.13 to Area 15 Regional Planning Commission, and $1,579.00 to Curtis Architecture&Design PC, for a total of $30,467.66, for work completed on the Faade Improvement Project. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said motion approved. Caligiuri introduced Resolution No. 18-08-147 entitled ÒRESOLUTION ACCEPTING A 2018 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AWARD FOR THE DOWNTOWN FAADE IMPROVEMENT PROJECTÓ and moved its approval. Yates seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Ottosson introduced Resolution No. 18-08-148 entitled ÒRESOLUTION APPROVING A PROFESSIONAL SERVICES AGREEMENT WITH CURTIS ARCHITECTURE&DESIGN PCÓ and moved its approval. Caligiuri seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. Yates introduced Resolution No. 18-08-149 entitled ÒRESOLUTION APPROVING A CONTRACT FOR CDBG ADMINISTRATION SERVICESÓ and moved its approval. Ottosson seconded the motion. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said resolution duly adopted. It was moved by Caligiuri, seconded by Drost to hold a closed session under Iowa Code Section 21.5.1.c. to discuss strategy with counsel on a matter presently in litigation or in which litigation is imminent where disclosure would be likely to prejudice or disadvantage the cityÕs position. The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said motion approved. It was moved by Walling, seconded by Burnett to hold a closed session under Iowa Code Section 20.17(3) to discuss collective bargaining strategy regarding Public Professional and Maintenance Employees Local #2003 (Police). The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said motion approved. The meeting adjourned to closed session at 7:24 p.m. It was moved by Moore, seconded by Yates to authorize the City Manager and Mayor to enter into a settlement agreement with Public, Professional and Maintenance Employees, Local 2003 (Police). The roll was called and the vote was: AYES: Burnett, Caligiuri, Drost, Moore, Ottosson, Walling and Yates NAYS: None Whereupon the Mayor declared said motion approved.
