Hamerlinck, Chairperson UNFINISHED BUSINESS GENERAL PUBLIC DEPARTMENT HEADS, ELECTED OFFICIALS AND EMPLOYEES County Auditor Eric Van Lancker reported the Iowa Supreme Court ruled Friday on the Polk County injunctions issued recently that affected the voter laws. He explained that ID numbers are no longer needed on the absentee ballot request forms and reviewed other changes. County Attorney Mike Wolf thanked Van Lancker and his staff for assisting in supplying information for the opioid litigation. He also informed the Board of Supervisors that he will be out of the office for an extended period of time and his office is prepared to cover any issues while he’s gone. Wolf would like to continue to offer the use of the public address system to the YWCA for its annual half-marathon. He also said he needs a server upgrade for the law software that he did not anticipate that will cost his budget about $9,000. County Mental Health Director Becky Eskildsen reported she has another vacancy in her office and she would like permission to work with Dawn on how to handle the position. County Engineer Todd Kinney said a pre-construction meeting is this afternoon for work on the road near the Clinton County Solid Waste Agency. He said one lane will be closed at a time. Supervisor Determann said he’s worked with a group on workforce development consolidation. He said shrinking the regions from nine to two doesn’t appear to be a good solution. He said the committee is working to make it four regions. He said the IDOT meets at 8 a.m. at Eagle Point Lodge in Clinton on Tuesday and the Highway 30 Coalition will be providing a presentation. Andy Sokolovich, Clinton Regional Development Corporation (CRDC), said an area labor shed study is starting soon in cooperation with the State. He said it will be used for attraction and retention purposes. He added new CRDC President Erin Cole begins her duties on Aug. 20. DISCUSSION WITH POSSIBLE ACTION HIPAA consultant contract: County HR Director Dawn Aldridge and County IT Director Betsy Smith reported the annual Carosh agreement is up for renewal and there was a slight increase. Smith recommended the Board sign the agreement because there is currently an audit being conducted by Carosh. Smith added their services will also assist her office during a transition time. Srp said he hoped that HR will eventually be able to take over the trainings. Smith said that goal is nearing, but staff changes have delayed progress. Roger Shindell of Carosh said the County still needs some training including specific training for its HIPAA officers. He said once those trainings are complete there are reduced services the County will need from Carosh. He said his firm also offers a service where they become the County’s HIPAA officers. A resolution to renew the contract will be considered next week. Snow removal at the Satellite Office: County Facilities Director Corey Johnson asked permission to go out for bids for the snow removal at the Satellite Office in DeWitt. He will bring back a resolution with bid results to a future meeting. 10:17 A.M. Drainage Districts - Consider a brush and tree weed spraying contract – Drainage District #20 & Drainage District #23 - Receive an annual presentation from the Iowa Drainage District Association Don Reffer, B & W Control Specialists, said eventually everything will be done in a year as they have been cleaned and sprayed. Reffer said his service doesn’t do noxious weed control. He said traditionally that is left to the adjacent property owner because the weeds don’t typically affect the drainage. The following resolution was presented and on motion approved: RESOLUTION #2018-232 WHEREAS, the Clinton County Board of Supervisors, acting as Statutory Drainage District Trustees for Drainage Districts 20 and 23 has requested a proposal from B & W Control Specialists for control of noxious weeds, and tree and brush control in Drainage Districts 20 and 23; and WHEREAS, a proposal from B & W Control Specialists has been received; now THEREFORE BE IT RESOLVED by the Clinton County Board of Supervisors acting as Statutory Drainage District Trustees for Drainage Districts 20 and 23 that a contract be awarded to B & W Control Specialists as listed in its proposal; BE IT FURTHER RESOLVED that the Chairperson be and is hereby authorized to sign the proposal and the attached Agreement for Tree and Brush Spraying on behalf of Drainage Districts 20 and 23. He said at the Federal level, the Waters of the United States would have brought Drainage Districts under the jurisdiction of the EPA which IDDA did not support. He said the new EPA director is backing out the Waters of the United States. However, the EPA was sued based on a claim the process to back out of the rule is illegal. Torbert believes it will eventually go away. He reviewed the Des Moines Water Works lawsuit that was dismissed and it was the best possible solution for IDDA members. However, he said a cautionary point from the lawsuit is that it sought to have tile outlets be declared a point source and that part was not actually litigated and could be pursued in the future. He said water quality legislation has been approved and good news is that there is additionally money for water quality monitoring. It also included that Drainage Districts are eligible for those funds. He added while funds have been made available, there isn’t enough. Torbert said a sales tax increase in the State that is being discussed could impact the funding of the legislation. The Board of Supervisors adjourned to meet on Monday, August 20, 2018. Contract Operator Transition – Potential Action – Camanche: thank you for attending this special meeting. I was invited by Rittmer to come out and assess the situation. I came out on August 13th with Seward and Rittmer. We saw several things that need to be corrected. Then yesterday Seward, two Barker Lemar representatives and I walked the site. I don’t want to say anything bad about the previous operator, but things were let go. We have 59 photos to show. Seward: Barker Lemar came to inspect this week the areas that need additional cover not completed by Progress Contracts. Chairman Varner also inspected the issues. Brian Rath of Barker Lemar has established that we have lucked out a bit. The liner was not torn or cut, but was simply exposed. Work will need to take place to replace soil wedge or abutment near the exposed liner. Additional cover needs to be placed on the Eastern portion of Phase E-1 cell and intermediate cover needs to be added to Phase 1 cell. Progress should have done this before they ran out of time. Pictures were taken. I went to file a claim on Progress Contracts Insurance for the tarp machine and the liner. I was informed by his insurance company that insurance policy was allowed to lapse in February. CCASWA was not informed of this. Legal counsel was notified. Invoice has been sent to Progress Contracts for tarp machine damage and labor to repair it via certified mail. Locks to gates have been changed. Brock Swan of Progress Contracts called and asked about payment. I notified him that the board has decided to withhold payments until work was finished. Swan then told me he could not pay to get his truck out of the shop then and that we might as well pay Rittmer to do the work. Excavator was moved from sedimentation basin to area near White Barn. Swan has moved most of the equipment he had on site. His off road dump truck has been sold to another company that will pick that up. It appears that all of the implements have been moved from the White Barn area. Seward and Camanche presented slides of photos to the board. Pictures showed uncovered areas of trash and debris, growth of weeds, conditions around the white barn, etc. DeWitt: This didn’t happen overnight and should have been noticed by Seward as part of his job. Seward: Progress Contracts and its employees were notified repeatedly that these areas needed to be covered. Camanche: Seward’s main responsibility is daily operations. We hired Progress and Rittmer to make sure the landfill is operated and maintained. Seward did his due diligence by making Progress aware things needed to be covered. DeWitt: Going forward we need checks and balances in place to make sure this does not happen again. Jeff Rittmer: Trees are trying to grow. DNR doesn’t like that. Seward: Trees root down and bust open the cover cap and then allow water in for leachate generation. Camanche: I’m in favor in going out for bids, but we have things that need to be taken care of now. Goose Lake: How thorough is the DNR inspection? Seward: DNR will usually walk the working face and any other areas they feel are concern. Andover: When do you expect to see DNR again? Seward: Could be any time. They don’t announce inspections often. Clinton County: What’s the threshold on change orders when you have to bid? Seward: I’m not aware of the legalities involving change order amounts. Rittmer: I’m ready to fix the issue. You have an hourly rate to go by. Clinton County: could entertain a motion for up to $25 thousand to begin the work on it and check with state law. Rittmer will need to add dirt to be able to reach the areas that need cover. DeWitt: Work down a list prioritized by severity and work this in phases. Seward: Generally the DNR will work with you if you are making the efforts to fix the problem. DeWitt made a motion to allow Rittmer to do the cover work on the Phase E-1 cell (areas that need cover) a price up to and not to exceed $25 thousand. Clinton County seconded. Clinton: why are we not consulting the attorney first? DeWitt: Attorney has been contacted. Clinton: Attorney should be contacted almost weekly at this point. Andover: Would we be wise to contact the DNR about this problem? Seward: I can tell them we are trying to expedite the situation. If people aren’t listening and following directions, then please bring it to the attention of this board for guidance. NEW BUSINESS: A. 28 E Update: - Clinton County: complimented Camanche, DeWitt, and Seward on their help at the Mayors meeting in July in DeWitt. Board of Supervisors is scheduled to take a final vote on Monday on the 28 E agreement. That results in a new issue. Because the finances have changed, then this board will need to decide if the voting structure has changed. Everybody else will need to approve the 28E. The board will need to determine how to conduct itself for voting purposes. The county approval essentially approves the levy. DeWitt: First and foremost is how we are going to vote. Goose Lake: Wouldn’t all communities have to sign off on it? Clinton County: The old 28E is based off the head tax. The county will establish the levy. Clinton County: At what point does the new 28E take effect? Goose Lake: Wouldn’t it be more appropriate for the 14 entities to all sign it first. Clinton County: If a municipality does not sign it, then they essentially lose the voting rights until they sign it. They also still have to pay the levy because they are under the county’s jurisdiction. Several members indicated it will be done by the next meeting. Delmar: Are we going to send documents out to all of the other entities that don’t attend? Camanche: going to have to do that. Clinton County will send out the sample resolution. Every Mayor has to sign the same copy of the 28E. Clinton County: You have to have a committee meet to establish bylaws. Committee will be Camanche, Clinton County, Low Moor, and DeWitt.
